Beginning on June 6th, there have been meetings between private counsel and Department of Justice (DoJ) counsel to discuss how to proceed. The other counsel lodged files after April 1st. Those cases are currently held in abeyance while the parties decide how to proceed once Bill C-38 is proclaimed.
The issues are: (1) who will be included in a motion to bar the Minister from destroying the pre-Bill C-50 applicants' files: only those involved in the litigation or all impacted applicants; and (2) will the litigation proceed (as did the litigation I just concluded) (a) as individual cases, jointly managed, or (b) as a true class-action lawsuit, covering all the affected FSW applicants. If by (b), who will be selected as counsel for the class-action lawsuit.
There can be no announcement on CIC website about the refund until after Bill C-38 is proclaimed. There is not likely ever to be any announcement about the class-action lawsuit, absent a court order to that effect.
