So I applied for my spousal sponsorship application and sent it in and its still in process, I am an odsp recipent so I would fall under receiving social assistance while disabled that's alright now I wanna know if I plan to apply for a job in the coming days will that anyway affect my application in process or do I need to report to them while the applicaton is in process if I land a job or can I wait till after its finalized? As far as I know being on ODSP as a disabled person won't get you flags on the application but you will just need to sign an agreement that spouse won't go on social assistance after she lands in Canada but if I land a job before the application has been finalized and I already have it sent as an ODSP recipent would that change the status in any way?

It doesn't matter if you are on ODSP or not. Just keep they updated as to your status.

Sponsors of dependent children and of spouses, common-law partners or conjugal partners (unless they have dependent children who have dependent children of their own) do not have to meet financial requirements, but they do undertake to provide for the basic necessities of the sponsored applicants so that the applicants do not need social assistance.

ODSP, as far as the CIC is concerned, is not social assistance.

hey there
I sponsored my wife on jan 2014 i recieved odsp on feb 2014 i was denied sponsorship because of the 1 month dfference I Mailed CIC and told them actually i was disabled from 2011 as stated on my disability tax credit. While on social assistance it was reason of disability while waiting to apply for ODSp my doc has been signing limited participation medical form which stated my disability although not on ODSP officially . CIC called ODSP and they said it backdates to FEB when i applied on odsp, the sponsorship application was in JAN so that one month difference and they denied me. I find it unreasonable they have done this especially if the CRA Disability tax credit dates back too 2011. THey are causing me alot of pain. So i guess i have to re apply? i went to another lawyer he wanted 5000 to appeal. That isn't fair since I am disabled Why do i have to pay 5000 for a 1 month difference . So i guess i have to apply again? or would a letter from an MP help me?

thanks your help.

Always give the 100% correct information. One month is a also a big difference, why didn't you tell them the correct situation at first place? You should have applied after you have applied you ODSP. You were on social assistance while waiting to apply? that's a big issue. CIC don't care what were you doing. They just go with the facts, and they found the fact that you were on social assistance, not on ODSP. Case Closed. Probably you won't even win the appeal in this case.

Seniors can highlight more on this.

perhaps that was a loop hole until ontarioworks change their computers in nov. on a new system on the old system i signed limited participation agreement forms which should have been under the ODSP umbrella as a medicail condition stating i can't work for my impairment

I did give 100% correct information. This is CIC mistake for overlooking my case rapidly without calling ontario works and seeing what was the reason for me being on ontario works, follwed by the accepetance into the ODSP program. The one month difference Isn't alot of time considering I was disabled since 2011. This is a kick in my face and i feel disrespected. I contact minister of immigration and he said they forwarded the updated information to CIC,. I dont even NEED to appeal because i have been disabled since 2011 as stated on my CRA disability tax credit. Oficially on the ODSP program since Feb. Who decides im disabled ODSP or my doctor and Disability tax credit? ridiculous

It states i can sponsor and be on social assistance or reasons of disability last time i checked ontario works and odsp are both financial assistance programs either way I was disabled since 2011 no matter which program im on right?

Why is CIC doing this They shouldn't have denied it. This is a headache and a half or someone like me who has chronic fatigue on top of that my wife is pregnant and she can support herself while working part time and wont be part of the ODSP assistance since she can work part time and isn't leeching off our country, only i am , the disabled one, who had worked in the past at esso and sams club until sams club closed their stores then i got sick in 2011 and went on wellfare with doctors blessings.

This is soo annoying . I feel bad for people who can't speak english thankfully im young and educated although Im disabled Doesn't mean im stupid. I dont even want to Appeal because this was the wrong doing of the CIC agent in charge. They didnt have the skill criteria and overlooked my case without getting specifics, they only called the ODSP office. Thank god i have a disability tax credit which states from 2011 i have been disabled Since both CRA and CIC are Federal Is that an oxy moron or an ironic situation. Last time i spoke to the MP they said either i was disabled or i Wasn't . Since my disabliy Tax credit states im disabled since 2011 It shouldn't apply that my ODSP application or Ontario works application. One thing they got correct is they knew when i got my social assistance, since 2011. But I should be exepempt from the rules Since i was truly disabled since 2011 at the time of applying for my ODSP application so i can get more money 600 on ontario works 1000 on ODSP. I should have been protected under the Limited participation agreement form which has the following :

Notice to respect to the collection of Personal Information: then in fine print: This information is collected under the legal authority of the Ontario Disability Support Program Act, 1997 Sections 5,10,45,46 or the Ontario works act 1997 sections 7,8,15,57 & 58 for the purpose of administering Government of Ontario social assistance programs.|”

That means both Ontario works and ODSP should have had that information That i was on both social assistance programs or reassons o DISABILITY. So the moral o the story is CIC overlooked my file quickly if this is some kinda of loop hole then i should be rewarded in finding it and granting my sponsorship or my wife.

Instead of celebrating our pregnancy I am sick like a dog and having to go through all these things. I can imagine or people that dont speak english.

God bless everyone.;

You were disable since 2011, then what took you so long to apply for ODSP? and in the mean time you were on Ontario Works (Social Assistance), right? Technically you were on social assistance not on Ontario works, and that's what cic understood. You should have attached a letter from Ontario Works of you situation.

I am also disable since 2005, but applied in 2007, as I didn't had any idea of ODSP, and I was on WSIB. As I was disable and no one guides me what to do, even legal aid didn't took my case.

Anyways, I feel sorry for you. CIC should have looked deep in your case properly.

technically i was on social assistance since ontario works and odsp are both social assistance programs for reasons of Disablity. Language twisting and overlooking my case. If they are all about facts they should get one fact straight I have my disability tax credit since 2011 This is Federal Eveidence that i have been disabled since 2011. Ridiculous im very angry

Well, see if an MP letter works, otherwise its better to appeal, because you have new documents(a letter from an MP and a letter from Ontario Works, if you don't have one get one and attach it). That way at least you be saving some money and time.
