Bad news: today as per the agent, my application was sent back to me ob March 25 with the reason of my husband's birth cert from Nepal being invalid. Bad news today, refused ang residency application namin and I only have 1 yr left to stay here. We are finding ways to re apply as our certificate to apply for residency is already expired. We are finding ways to extend our certificate We hope it will be granted and that will take 30 days to process. On top of that my Work Permit will expire on July 23 and Anul's is in August, Next month will be the start of my Maternity leave and wont work for 1 yr. I am telling u this infos to let u know our situation here. I cant help financially this time. We have to make sure of our status here first. Im sorry if we are going to offend everybody but We have to be stable first and think of our selves and the baby before its too late and no other option left.I called AINP if I can send back my app to cic eventhough my nomination is expired already, they said I cant but then I can send for a request of nomination extension and it takes 30 days for the decision. I want to ask if anyone is on the same boat? Did somebody resent their app to cic eventhough their nomination cert is expired after being returned and got file #?
1 - Was your credit card charged ? MY application that was sent august 28th was erroneously returned Oct 6th 2014 due to birth certificate. I resent it with the same initial payment receipt . it arrived October 16th and i FINALLY got AOR a week ago. If your CC has been charged then you may have to repay. Just so you know, my birth cert was in the original package, i guess they just didn't see it . Summary is...from my experience, return due to birth certificate issues doesn't demand repayment, in many cases, initial payment is not processed. If in doubt, ask CIC directly not your agent. By the way, your agent should have caught this, that's his / her job.
2 - Fix the issue: If the birth certificate does not meet the standard spelt out by CIC, get an affidavit , notarized and signed infront of a witness stating that he/she was born on this date, to Mr and Mrs......... He signs it, the notary public signs it and notarizes it. This is accepted. Alternatively, you can get a new birth certificate for your husband.
3- while fixing the issue above (#2), apply for a nomination extension, and then resend everything back with extended nomination form.
I sympathize with you but the above is the solution to your issue. The only portion not under your control is the nomination extenion.....95% though an extension is granted. Your chances are good.
One thing...if indeed you've been charged, consider reapplying through EE if you have to repay for (why not). This way, you stand a chance of getting PR sooner that if you stuck with the old system. It can end up turning out to be a benefit. Do EE if you have to pay again.
