Number of Hours/Experience

Hi

I have completed my 37.5 hours per week equivalent for 2 years in November 2012 and I sent my application in December 2012.

Employment Start in Canada: February 2011
Hours accumulated as of December 7 : 3984 hours (attached paystubs with number of hours)
Application sent and received in CIC: December 21, 2012

My application is now under processing. I have been going through several threads and found that even if we complete the number of hours required before 2 years, it might not be sufficient for CIC. However, considering that it is 1 year of full time experience that is required right now (as per new CIC rules), can someone please let me know if this would be a factor for rejection? Thank you!

Your application will be assessed according to the rules in affect on the date it is received. Therefore, you will require 2 years of full time work. The requirement was 2 years of full time work AND at least 37.5 hours per week. You are not allowed to account for any hours over 37.5 hours.

Let's wait for a couple of the senior members to comment and confirm your ineligibility. If you are truly not eligible, I would recommend you withdraw your application, and apply again under the new rules. It hasn't been that long since you applied, so it would only delay your application 4-5 months.

Alternatively, you could wait for CIC to assess your eligibility (they are currently assessing July and August applicants), and decide on next steps at that stage.

Sending additional docs would not help at this stage. Your eligibility is determined by your work experience as of the date you applied.

Well, first I would suggest that you do the necessary calculations to determine whether or not your application has a problem.

1. Count the number of full-time weeks (any week that included 37.5 hours or more).
2. For all part-time weeks (any week with fewer thant 37.5 hours), add up the hours, then divide by 37.5 - that gives you the number of full-time equivalent weeks.
3. Add the full-time weeks and FTE weeks - if you have 104 , then you're OK. If not, then your application will probably be refused.

If you don't have the experience, you could withdraw your application and re-apply under the new rules. Be sure that you obtain an up-to-date letter of employment.

It looks like I just have 96 weeks of experience by the time I sent my application. If I consider withdrawing my application, do you think they would give the refund? In your experience, have you seen any cases who might have got the refund?

I think if I take action right away by withdrawing the application, I still will have sufficient amount of time. Please let me know!

Sorry to say, but you will not be getting your fees back. It sucks having to spend another $550, but think long term.

If you have already received your AOR, the status is "in processing" and you will not receive a refund.

I just noticed that your dates (February 2011 - December 2012) didn't even meet the 2 year requirement (24 months). You have to meet the 2 year requirement AND the hours requirement. So, your application will be refused.

The benefit of requesting that your application be withdrawn is that you can get on with submitting a new application right away -

Probably, they certainly can, but it shouldn't negatively affect the new application. You don't need to give a reason for requesting the withdrawal, but you can say that you realized that you applied too soon and will resubmit your application when you have met the requirements.

You can request this when you send your request for withdrawal, but don't expect it - normally they do not. And unless you submitted your PCC after your application, it won't be valid anymore.
