@legalfalcon i have applied for my TRV after getting Nov 2020 AOR for my PR (CEC Inland). I’m in closed work permit. Will this impact my PR or vise versa?
I have submitted documents received for my TRV from employer as my experience letter which states start of employment date in India and in Canada. I’m not claiming any points for job offer just for experience.
Will this be treated as BOWP as well? Can you please shed some light if BOWP for closed work permit people ?
So far no progress on my TRV (applied 30th dec, confirmation on 29th jan )

TRV and PR applications a re processed on their own merits.

subsection 22(2) of the Immigration and Refugee Protection Act states:

Dual intent

(2) An intention by a foreign national to become a permanent resident does not preclude them from becoming a temporary resident if the officer is satisfied that they will leave Canada by the end of the period authorized for their stay.

See https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/visitors/dual-intent-applicants.html

Not always the case. The following is from CBSA and info sharing is not redacted.

The Info Sharing status is in my notes as well, what I meant was the details of Info Sharing section in which they search different countries for information if we've visited them. This is what my notes have:

My friend's notes from IRCC in this section has all the details of his Info Sharing while mine from CBSA has this section details as blank.

What “all” details of his info sharing are in the notes?

Thanks @legalfalcon , so I might get approval for both TRV and PR or other way around I.e it might be refused as well. It all depends on the officer. Can you also shed some light on the document (experience letter) I have submitted for my PR. It has my start date in India and Canada with my noc specified on the file along with my roles and responsibilities. Will this be sufficient? And the document is dated sep 5 but I submitted on November 24th. Completed my 2yrs on sep 24th.

So you see s15 or 16 on the top right of the page. If so, then this section may have been redacted as CBSA does not do info-sharing and this the info is not directly under their control. See https://bit.ly/3kbKSOC

Since each application is processed and decided on its own merits, the decision can be different for each.

As per IRCC a work reference or experience letter from the employer should have:
  • should be an official document printed on company letterhead (must include the applicant’s name, the company’s contact information [address, telephone number and email address], and the name, title and signature of the immediate supervisor or personnel officer at the company),
  • should indicate all positions held while employed at the company and must include the following details: job title, duties and responsibilities, job status (if current job), dates worked for the company, number of work hours per week and annual salary plus benefits;
If your documents meets the above, no need to be concerned about.

Also, the letter doe snot have to mention NOC, if it does, not a problem, since you enter the NOC in the application.

If you don't then send a replacement. Number of hours worked a week is mandatory.

Info sharing does NOT apply to all applicants. Usually, affected applicants are those who have previously applied (whether the visa was approved or not) with any of Canada’s partner countries in the Five Eyes intelligence alliance i.e. Australia, New Zealand, the United Kingdom and the United States. 1. You should CBSA notes , They come out faster and they are better as compared to GCMS notes
2. You can order them from @legalfalcon website it’s reliable and good.
@sribala2000

It's almost as good as coin toss whether you will receive your GCMS file in 30 days or if it's going to take far longer (Some/one GCMS provider has disproportionately been receiving 90 day extensions, so beware from where you request)

This is based off stats from IRCC see
https://www.canada.ca/content/dam/ircc/documents/pdf/english/corporate/publications-manuals/atip-2019-2020-en.pdf

CBSA on other hand has a better track; review this detailed comparison for requesting Gcms Notes from IRCC vs CBSA https://bit.ly/34nuJPu that others are quoting from
