Notice of assessment of my parents only under my dad's name- pls help!

Hi everyone,

I just need help. I'm currently gathering documents to renew my PR card and and my parents.
One of the documents needed is Notice of Assessment. The problem i'm having is my parents never worked in Canada but they did file tax but the notice of assessment is only under my father's name. would this be enough for my mother aswell??

Please help and let me know. Our PR Card is already expired and i didnt apply a renewal before becuase i thought our citizenship application will be done soon but it's taking longer than i expected because they asked me for a RQ. Now i really need to renew our PR Card just incase of emergency.

Please help. Thank you!

Your mother should have filed taxes as well. Your father filing taxes does not cover your mother as well.

You can try submitting your father's NOA to cover both. However I would also recommend that your mother file her taxes asap in case your father's NOA is refused.

My sister-in-law is the one who filed the tax and she said that my mother is under my father's tax. i think she filed it as a couple but assessment is only under my father's name. is that possible?

Taxes are filed individually. Based on the above, taxes were only filed for your father - not for your mother. The fact that the assessment is under your father's name supports the fact that taxes were only filed for your father.

i have all the other documents for my mother exept for the tax assessment. i'm hoping they will take the NOA of my father for both of them.

Is there another alternative i can send to replace NOA for my mother? she doesnt have an income anyway.

People without NOAs can provide an explanation. But usually a good explanation is something like the person was not a tax resident for that year (lived abroad, etc). Unfortunately for your mother, her explanation is "she didn't know she had to file taxes" and that may get her to have issues with CRA. I guess one option is to back file her old returns to get her squared up. or maybe CIC will not care that she doesn't have NOAs. Hopefully someone who dealt with this can respond.

Is your sister-in-law an accountant? I hope not. I can't believe she gave that advice.

I called cic. They just told me to put all the the documents and the NOA of my dad and a letter explaining y there's no NOA for my mom. I told them my mom didn't work and no income so no tax was filed.

That should be fine. A person without income is not legally required to file a tax return and therefore wouldn't have an NOA. I'm sure CIC sees that situation often enough in PR renewals, from other stay-at-home spouses, students, younger people still being supported by their parents, etc.

There are many reasons to have to file besides just employment income. For example if your spouse claimed some benefits/credits, both may have to file to get it. If you have any bank account that earns interest, that is income that can be taxed (depends on the account).

I was attempting to make it simple for the OP, without touching on the more complicated aspects of capital property/capital gains, RRSP/OAS/EI repayments, etc., that may legally require a person without income to file a return.

For the simple situation of person with no income, s/he is not legally required to file. This is true even if their spouse wants to claim some form of benefit/credit; deciding not to file in that situation would probably bad for the marriage but not illegal.
