Hi guys, need your advice in the following situation:

My friend owed me money from quite a while back, sent me back my money after I received the ITA (significant bit of the PoF requirement). However, I now read here that I will need a notarized affidavit from him to avoid raising eyebrows. In the meantime, a couple months of my salary has credited and I don't need those funds to meet the minimum requirement anymore.

Should I return the funds back to him to avoid the complication of getting an affidavit made (he's in another city right now), or should I travel and get this affidavit made and submit with the excessive funds?

Better is to get an Affidavit signed from your friend as its your money anyways .... However both options can work for you.

But I wonder if returning the money to him would cause suspicion anyway, as it could be perceived as a way for me to bump up my average balance.

It would be hell of a lot more convenient to give the money back for now just so I don't have to go through the hassle of explaining it, but there would also be a huge credit and debit in my account, which just might require explaining anyway!
 
Simply get a declaration from your friend stating that the funds are a gift not a loan and add proof of transfer.

No need to notarize it.

Wait, won't this also require the gift deed to be notarized? A simple declaration signed by him can suffice?

Hahahah. Okay, in my defense, I hadn't even planned on getting anything notarized until I came across this forum.

I am repeating myself here but only because I want to be sure I've got this straight: GIFT, no notarization required. Getting money back that someone owed you, notarization IS required.

That's just weird. Where's the consistency?

I've lent my friend that money back. Yeah, I have a huge debit and credit that's going to appear in my bank statement, but I have enough funds and it's coming from my salary credits. SHOULD BE ENOUGH.
