not in 38 list, pls help

Could anyone let me know if someone have previously experience in 38 list (within last 10 years) but currently working in out of 38 list (due to recession and not finding desired job) So, what are the chances to successful his application?

A 1 year experience or more in the 38 list qualifies if it was within the last 10 years even if it is not what you are doing now.

If you also meet other requirements such as 67 or more points on self assessment and you pass your background check and medicals, you have a 100% chance of being approved.

Canada immigration is not a lottery. If you meet the requirements, you are in.

It means a friend of mine have worked as an accountant but currently in sales and marketing so, its eligible?? dont you think it could be bad impression on his application due to out of field???

There is no bad impression. There is qualified and not qualified. If your friend has more than 1 year experience as an accountant and also meets the other critieria like 67 points, clean background check, passing medicals, then your friend is qualified.
