non-resident, 6month twins pregnancy in Toronto

Hi, I arrived on march 2013 under a working holiday program, on february 2014 I got pregnant from a non resident boyfriend. I went to a community center before my status expires and they advice me to not get another one so I can receive help for my pregnancy and delivery.
Now I have no status, I'm 6 months pregnant and I'm getting free health treatment in the community center, but recently my mom tried to enter Canada and she was send it back to my country and the official told her that they are looking for me as I have no status.

Can I be deported and send it home while I'm pregnant?
Is there something I can do to get a status as visitor right now?
Can my babies, if they born here get citizenship and then revoked if we are sent back to my country?

Is there anything I can do to fix my situation and remain in Canada before and after my babies born?

Please I need help!!!

When did your status expire? If you are still within 90 days of that expiry then you can apply to restore your status. However if you're beyond 90 days (I think you are since you arrived March 2013), then it's too late to restore your status from within Canada.

If your babies are born in Canada then they will be citizens - and no, this citizenship won't be revoked if you are sent home afterwards.

Can I be deported and send it home while I'm pregnant?

Yes, but only if you are deemed medically safe to travel. If you are too far along in pregnancy or doctors do not recommend you flying, then a deportation order will be delayed until after your delivery. Then of course they will wait until the babies are also medically fit to fly.

How will you do the actual delivery? If it's in a hospital, there could be a big charge for that.

So you are saying that the community centre advised you to get out of status for them to help you? I have to say you were given very bad advice. You are now out of status, and from what you say, about to get deported as soon as immigration catches up with you. When your status expires, you have up to 3 months to restore it or you must leave. If you arrived in March 2013, your working holiday visa would have expired in March of this year so 5 months ago so in your case, it is too late to apply to restore.

Right now, you don't have many options. If you get deported, it will be hard for you to return to Canada in the future. You can however avoid deportation by leaving of your own accord. Your baby will be a Canadian citizen if born in Canada and this will not be revoked. However, your baby being a citizen will not in any way help you stay in Canada.

UPDATE.

A few days after I posted this I gave birth my twins with 24 weeks and 3 days, (17.08.2014) the very same week because all the stress that the CBSA made me go thru, since they arrested my mother at the airport acusing her of trying to stay.

My babies remained at the hospital with high risk for almost four months, they almost die, they had lots of treatments, oxigen, surgery, blood transfusions, tons of exam. Me and my boyfriend were struggling into lots of problems and I was so depressed that I wasn't eating or sleeping it was awful.

Now we are doing better,but my twins needs a follow up for 5 or 6 years at the hospital, I go once a week with them for different reasons. I can't work as I have to take care of them. My boyfriend works in construction so now with this weather is almost impossible, we are having money issues actually.

This situation is a non stop since they arrested my mom who was coming here to help me the firsts months...

Is there anything we can do now, with all this?

If your boyfriend still a non-resident (i.e. not a Canadian permanent resident or citizen)? Have you been out of status since you last posted in August? If so, there's unfortunately nothing you can do to restore (legalize) your status from within Canada.

Does your boyfriend qualify to apply for PR in Canada under any immigration program?

@ andrempx : Congratulations for having twins, i hope they are well,and stay well forever.Now i have few things to say:

1- DO NOT be depressed.It is not the greatest thing and it will take you to nowhere, life is just like an electrocardiogram, it is best to be up and down otherwise we are dead.

2- Your problem is not actually a problem, there are many ways to get out of it.

3- You screwed up and you know that. This is awesome (thump is up).

4- Now what do you have to do. hmmmm

5- Your boyfriend works in a construction,so he might be eligible to apply for PR under skilled worker category (if he still has a status in Canada ). You can stay illegally here and try not to get in any trouble.Then once he gets his PR,he can sponsor you and fix your status .

6- Your boyfriend has no status and you have no status. You can apply for H&C, this may take few years,which is okay because your kids needs attention for a few years as you mentioned.Meanwhile, try to vounteer in a community centres as much as you can( this will help your application alot,beside the fact you have a Canadian kids),.You can take your kids with you. Try to have friends there and they may in future support you with letters so you can send it to CIC. Apply for H&C may give a chance to apply for a work permit ( i am not sure tho)

7-You'r financially screwed,and weather is not helping your boyfriend to work. Well, there are tons of kitchen jobs out there and mostly are cash paid.( If someone will get butthurt for saying that,then you sir know nothing about how many people work cash in this country,no race is excluded).

8- You can always go seek help from people. Go to church,Mosque,Sinagauge,Temple. If you are an athiest, then pick one religion and you don't have to be religious . There are always people who care in worship places. You may think they are brainwashed,but they actually have hearts.

9- ^ It works trust me.

10- Please learn that i am not an immigration expert,so i may have said some wrong information,however,i learned that from the people i went through during my stay in here. Believe me, i have seen much worst situation than yours.

Wow that community centre had no business telling you not to apply for some kind of permit or visa. They clearly don't know anything about immigration.

I would suggest looking into a Humanitarian application for PR. I am not sure of the process or requirements but this can be granted under certain family situations. It basically gives CIC the ability to approve people under different situations that would not meet requirements for any usual stream.

The problem could be that because you stayed in Canada illegally it could hurt your application. If you had not let your status run out there would have been a good chance of getting PR this way now that your children are Canadian. But as I said the fact that you stayed illegally may have complicated it for you.

Has anyone contacted you from CIC yet to talk to you about your situation?
