Non-Accompanying to Accompanying

Hello,

I have an issue that I need resolved quickly. I need to send in an amendment.

My husband has 2 children (16 and 19 at time of application) now 18 and 21 and are both enrolled in full time school overseas.

We had listed them as non-accompanying him to Canada. But now with the crisis in Europe we want them to accompany him.

My question is, they are still in school and would like to finish school there. I will send the amendment in to have them accompany him, but how long after approval must the land in Canada and can they return to their home country to finish school? They usually come to Canada 2 months every year already.

We already sent in their medicals and all police clearances as requested for non-accompanying.

They will have until the date on their CoPR documents. This is usually the expiry date of their most recent medical examination or their passports, whichever comes first. Yes they can return to finish school as long as they meet the residency obligation requirements.

I have no idea how long it takes to 'alter' them from non accompanying to accompanying.

When it is all changed, yes, they can land in Canada then go back and finish their schooling in whatever country they are currently in.

They will have to be sure to do the residency requirements to continue their PR status in Canada though. So you'll want to be sure that is clear with them.

I guess you remember - when you signed the forms they asked if you were sure to include the children as non-accompanying... My sugestion - the only certain way is to withdraw your application before it is finalazed and re-submit it again.

Another option - contact the CIC directly - 1-888-242‑2100 (inside Canada) and ask them this question - maybe they will give you the right answer.

Thanks everyone,

I have already spoken to cic. They said to send in an amendment.

I know that they have to stay 730 days in 5 years but being in school there does not allow them that time to be here. That is the problem!!

** Just realized that the 2 years residence in Canada does not need to be done on an average yearly!! ;D They can come a couple of months during the school year and make up the time later before the 5 years expire.
