Non accompanying Spouse! Please help.

Hello,
I am married and my CRS is 440. I want to create an Express Entry profile showing my spouse as non accompanying. So, I won't loose any points and will receive an ITA in the next draw. But my lawyer is saying I will loose points, doesn't matter she is accompanying or not, since I am married.
Is it true?

Not true, it does matter score wise whether she's accompanying or not.

just a quick one please. I am married with 2kids, got a master's degree from U.K. & about to register to write IELTS, however my spouse who has a good job here in Nigeria isn't wiling to be part of this application process as he isn't ready to migrate yet. My question is; it possible to get an ITA without him involved? Will I need any of his documents during this process? Meanwhile I have 5 years of previous work experience but not currently employed. What are my chances please? how can i get a UK police report too? I will appreciate all your inputs.

You can add him as non-accompanying spouse but when you receive your ITA you still have to get medicals and PCC from him.
