Hello - I posted previously regarding my wife's 22-year-old "dependent" (in terms of this process) son. We decided in the end to complete all the forms he was needed to complete just on the off chance that he one day does decide to emigrate. Now a police check has come back with a minor offence, for which he was given a small fine and a suspended jail term (also short). The police certificate says that he is not a threat to national security, but has this one mark on his record.

He is marked as non-accompanying on the forms.

My question is: What if any impact might this have on my wife's PR application?

If there is the remotest possibility that her application might be rejected or even delayed, we may just forget this and do what we should have done in retrospect -- have him sign a notarized document saying he refuses to participate in the process, and my wife signing another saying that she accepts that he will not be allowed to emigrate.

From your previous posts, I'm guessing you are referring to the 21 year old son. A 22 year old is not a dependent. What is the crime? When did he finish his sentence?

There is no "one day". If he is included as non-accompanying, his mother would need to sponsor him after she is a PR. However, he will be 22 or older by the time this app is done and no longer be a dependent. Either he is included as accompanying to become a PR with his mother or there is no point in including him.

Are you referring to what is needed to exclude him?

He needs to say that as a legal adult, he does not want to immigrate and refuses to be included in the application, take the medical or provide any forms/documents.

She needs to say that she understand that by not including him, he will be excluded from the Family Class and she can never sponsor him. She should also mention that given his current age, she would not be able to sponsor him in future anyways because he will be above the age cut-off.

If that is the process to notarize documents in her country, then yes. I suggest that the son also provide a notarized copy of his ID.
