According to the US application guide:

"If you are divorced or separated, you must include proof that you have custody of the children, that you have fulfilled all obligations in custody agreements, and that the children are free to move to Canada."

My husband has joint custody of 2 children that will not be accompanying us to Canada and will be staying with their mother in the US (I believe he has 20% of the custody and mom has the rest). Do we still need that document? Does anyone have an idea of what documents the Canadian government is looking for in this case? Would a notarized letter from the mother stating that he has fulfilled all of his obligations as per the custody agreement do?

i think what you are reading is for when children are accompanying you to canada?

if they are not accompanying, i think sending the custody agreement and providing a letter from their mother will prove helpful. i'm sure others with the experience can provide more detail.
 
Even if the children are not coming to Canada with their father and they are under the age of 18 which i am guessing they are, they still require to have a medical and you will still need to include them in the application. As for proof of custody you won't need anything from the mother if they aren't coming.
