non accompany dependent

Hi,

I'm a foreign worker in canada. I got my divorce and got married after. Now, my spouse want to sponsor me and I have problem with child custody.

1. it is not included on divorce application.
2. where do i file it, in canada or in the phils? kids are in the phils living with there mother.

we are planning to file a non accompanying dependent. How does it work? I spoke to CIC and was told that child custody is needed regardless.

Please help!!!!

Even as a non-accompanying dependent, the children have to be medically examined and be included on the application. This is just to preserve the possibility of you sponsoring them later - it does not mean they will be coming to Canada with you when you are accepted.

Maybe talk to a lawyer in the Philippines about getting a formal custody letter. You will need some proof the mother has custody.
