Nomination issuance - H1 extension filed

I have a question :
I have applied for alberta PNP and had got a file number in august, my current H1 is expising in
January and I have applied for extension and have a receipt number from USCIS.
IF alberta decides to issue me a nomination sometime in January, they would ask for I-797 form and current paystub,
I will havethe current paystub, but might not have the 797 form till then as H1 extensions these days are taking a few months.
Any suggestions ?

Hi,

I was in the same situation like you when I got the request for documentation on 20th November and was asked to send the documents by 23rd. I sent them the receipt notice and pay stub. The only exception is that I received my extension on the 25th November so I was able to send them the copy of extension. I have NOT yet received the nomination.

When did you file for the extension? It takes around 50 days for approval and another 7 days to get the approval notice on hand.

thanks for the response ....filing the extension this week, current H1 is valid through 01/30/2010.
Would uscis receipt suffice incase I do not get the approval ?

Gaurav,

I am not 100% sure if the receipt will suffice. But if I were you I would apply with premium processing option where the extension is guaranteed to come in 15 days. It cost $1000 for premium processing.

yes I am applying via the premium processing.....but have seen cases where even under premium processing it takes a few months....so just wanted to know of options before hand.

Maybe I am wrong, but what I heard about premium processing is that if they do not approve it within 15 days, they refund the premium fees.

Things are a lot changes now, they do not guarantee the 15 day thing.....and moreover they count ths first day as the day when the application goes into their system and not when they receive it...so the actual time might be longer than 15days...inaddition these days most cases are in for RFEs so that extends the time limit further...
By the way how long ur approval took ?

I did not file for premium as I had 6 months remaining on my H1 when I applied for extension. Mine was approved in 45 days. No RFE etc. My friend had only one month balance and he went for premium and got his extension in 10 working days. Again no RFE.
