NOC 0213 Refusal. What To Do? Urgent Help Needed.

very sorry to hear about your refusal. Its hard to undersrtand why they reject sometimes.
they must have some valid reason, else they wouldnt simply reject, like a popular misconception here.

my guess is, an indian 3 yr diploma gives you entry to 2nd year of engineering course...may be thats why they took it as 1 year of education, FT at uni level. also, you can join the diploma after class 10 . YOu dont need to have 12 years of schooling to join diploma courses. may be thats why reduced points. for you points seem to have been calculated for 10 years of school + 3 years dploma = 15 points .

I am confused, when they say Diploma, they should atleast specify and compare it to some standard, for eg, a canadian diploma standard..
For Eg, in denmark immigration we8bsite they clearly specify how much points for indian/pakistani degrees, their equivalent etc

your education is only diploma
which will give you only 15 points.
in cic.gc.ca the information in education was based on canadian credential.
but in india diploma that is less than the bachlore.
so your diploma, credit you only 15 or 20 not 22 points.

so re apply by improving ielts

I am ready to give IELTS again to achieve more points which will help me for canadian immigration. But, main problem is , my file is been refused & the NOC code 0213 doesn't exists now!!!! Means, i need to start from scratch by making new immigration application. Is it true?

Except if your occupation 0213 is NOT on the list in July/2012 then you are NOT eligible to apply.

Hate to be the bearer of bad news. But as you didn't submit proof of the relationship of your spouse to her brother, it is too late now as the application has been refused. Even if ND reassesses your education, you still only have 65 points.

Yes I concur. CIC will only reassess a case if you can reasonably prove they made an error with the documents they had at the time they made the decision. Since there wasn't proof of spouse to brother relationship, they will not now grant points for this even if documents are now submitted.

This is why it is so important to ensure the visa office have all the correct document before they make their decision, since they will not consider anything else sent afterwards.

Thanks for your moral support. As you are now aware that I have got refusal due to
* education = 15 points
* Proof of relationship in Canada = 0

Overall score is 58 points only.

Moreover, i have just submitted my final marksheet & top10 bonafied certificate,which i think was not adequate. So, i am going to resend all my semester wise marksheets to CHC,New Delhi. Also i will be attaching "All possible proof of relationship of canada i.e. My brother-in-law's rent agreement, Electricity bill, income tax letter".

CHC still have over 160,000 FSW applications in their inventory, even after they scrap the proposed 280,000 pre-Feb-2008.

So from this angle I can kinda see their point, they cannot be expected to continually leave the door open for appeals by applicants sending new documents. They can only make their decision on the documentation they have at the time.

I realise that's not much help, but have you considered trying to secure a job offer and reapplying under FSW Category 2?
