no recruitment effort under PGWP! Jes_ON pls advice!!

Hi Jes,

My employer is also concerned about the recruitment effort. I have told them that no recruitment effort needs to be shown as I was hired under PGWP. However, they are asking whether they need to show "no other canadian was found for the position thus they hired me". Is that something they need to show somehow? if yes, what is the procedure to establish that without recruitment effort?

No, recruitment efforts are not required if you are initially hired with a PGWP and the employer is willing to hire you permanently if you obtain permanent residence.

Thanks so much for confirming. But on the application for LMO there's a question to the employer:
1. Have you attempted to recruit Canadian citizens/permanent residents for this job?

- the ans should be YES correct? because they did advertise the position for citizens/permanent residents at the time I was hired in July 2011. or should the answer be NO? I'm confused!

also I'm confused about this question:

2. Do you plan to train Canadians/permanent residents for the position to be filled by the foreign worker?


as per employers guide: Please indicate whether it is your intention to eventually train one or more Canadians for the position that the foreign worker will fill temporarily. If yes, please describe your intent. This question refers only to the position the foreign worker will fill, not to your general efforts to train Canadians.
should the answer to this question be yes or no when I'm hired since July 2011 on a two year contract as an insurance broker?

"No, because the foreign worker was originally hired while holding a Post Graduate Work Permit, and we want to permanently employ him/her following completion of their PGWPP."

Not sure about this one. I would say "No, because it is our intention to keep XXX as a permanent hire if he/she becomes a permanent resident."

Just try answering the questions honestly, since they don't really impact the decision. But to the extent possible try to turn the answers to your advantage: HRSDC's job is to make sure you are not negatively impacting the overall job market for canadian citizens and residents.

1. I answered the first question with a "YES" as I have been hired from among other Canadian candidates
2. I answered the second question with a "NO" as the position I filled was unique filling a specific vacancy needs (this is usually the case when number of positions open is 1) and therefore - since your employer is supposed to offer you a permanent position assuming LMO is positive, then there would be no need to train anyone.

I sent whatever it was requested. From the top of my head, I sent the application filled by employer, job contract, a reference letter and a copy of my PGWP (I highlighted the section mentioning this so they won't miss it).

Thanks for sharing but this link gives a long list of documents that needs to be sent and I understand my employer should only include the one that applies to him only. According to the link, as a returning employee they should include:
◦payroll records;
◦time sheets
◦job descriptions;
◦copies of the employer-employee contract;
◦collective agreements
◦TFW’s work permit
◦provincial workers compensation clearance letter or other appropriate provincial documentation
◦receipts for private health insurance (if applicable)
◦receipts for transportation costs
◦information about accommodations provided by the employer

If I send the docs in bold is that enouugh?

Your employer is a "returning employer?" Are you sure? That means that they have applied for an LMO before...

yeah, I think they have applied before once or twice before for few other employees. So that means they are returning employer correct?

Yes, it does... your employer can always call HRSDC to ask what documentation is needed...
