citizen of mongolia. lived in the us for 10 years starting my high school days. graduated in the US as a mining engineer. i now own my own business here in mongolia. 5 years of experience. no job offer. with the current down turn of mining industry not likely to get one soon. but don't really need a job in Canada. I can fly in and out of canada for work. just want to raise my kids in Canada. what is the best way to go about it? also do i have to take the language test?

I hoped that i may not need to convert my us diploma through a credential agency and no need to take the language test. i guess i was wrong cause i just got an immediate denial from MyCIC. saying Profile Ineligible

Language test is mandatory. You can't apply without it. And yes - you need to have your education evaluated.

You should spend some time reading through the information on the CIC web site - these are extremely basic questions.

If you are not working in Canada, how will you meet the required residency period in order to keep your PR?
 
I can easily work from Canada for about 3 months per year. Not a problem.

I started off as a mining engineer, but now I run my own company. I do not have a job offer yet. I'm planning to apply FSW. Express Entry. Should I apply as a senior management or mining engineer? Which one is more likely to get approved? and what about provinces? Interest towards certain provinces get prefer-ability over some popular provinces?

Might be an idea to do some research into the whole PR process and see if your plans will work. Three months is not going to cut it.
