I am On Study Permit in Canada since 23 August 2012, joined already classes for Fall Semester 2012 from September 5. My Husband did not applied with my application for TRV or OWP to accompany with me because he previously applied for Immigration under Federal skilled worker and got refused in 2010, so we were scared that if we both apply together, may be none of us will get visa. This theory proven to be true and I got my study permit without any problem.
But here new phase of depression started for me since I left my spouse back home
I showed in my own account ($25232/=) as prove of fund, including ($7382/=) First semester fee and ($3179/=) 4 month accommodation fee, after paying both of them there is now ($14671/=) only remaining in my account. This amount of ($14671) has also been transferred in my account in Canada.
My Question is me and my husband is exhausted thinking about which application my husband should submit to Visa office so that he can join me as soon as possible in Canada.
1: If we go for TRV made outside of Canada he has only my previous bank statement and previous balance certificate in hand of my account (which I used at the time of apply my study permit) as a proof of funds plus + weak point of refusal FSW application history.
2: If we go for open work permit, then most of the members on this forum are not encouraging to submit OWP from the home country and also this OWP form is very much difficult to fill as all questions are related to the arranged employment.
What plan we should follow..any Idea...?
I cannot concentrate on studies and feels in the middle of nowhere.
Experts and members gone through the same experience please reply.

I would try applying for the TRV.

You can certainly try using your previous bank statement and previous balance certificate and hope CIC doesn't request new proof of funds (I don't know what will happen). And yes - the fact that your husband previously applied for FSW will likely work against him since it demonstrates that he has a strong interest in moving to Canada to live long term. To counter this, your husband should provide as much proof as he can that show ties to his home country.

Again, all you can do is apply and hope for the best.

There's no guarantee your husband will be approved and you knew this when you applied for your study permit. So there is certainly a chance that you will have to complete your studies in Canada without your husband there.

Only two things work in this world: God or Semi God aka Money

If he does not have enough money in his account, forget about applying for a study permit.
Since you have to furnish your studies, you can't help your hubby financially.
He has to borrow money from other source or by selling a property etc
Your old statement won't work. If that is verified, turns out to be false, a permanet ban will be in order for your hubby. Fake docs or untruthful info won't work.

I think fundwise they still might be alright. but the main issue for ur hubby is going to be to convince them that u both will come back after ur study permit. he must need to have very strong home tie to show like, family house, or strong recommendation from his work place.

Hi Panasonic,

Sorry to hear about your case. I too am applying for a study permit and my husband is applying for an open work permit. His best friend recently went to Canada. His wife got thru the UoT, so she applied for a study permit and he applied on an open permit and got it!. It states clearly that a spouse is entitled to be with you when you are on a study permit. I would suggest two options:

- If your husband wants to come and work there better he applies for an Open work permit and in the Schedule 1 form he will need to clearly mention that he is the dependent spouse applicant

- If its of priority that your husband just joins you at first then apply for TRV as suggested and once he is there he can apply for an open work permit.

In either of the above mentioned cases please ensure that he has sufficient funds to show( to support himself), this could include property, FDs etc.

Your best chance is to apply for the TRV for your husband.what ever you show funds,his current job but do not miss the home ties part.

Work Permits for Spouses and Common Law Partners (including same sex):

Accompanying spouses or common-law partners of study permit holders can apply for work permits that last as long as the study permits of their student partners, if the student is studying full-time at the time of application.

Most partners come as visitors and apply for a work permit by mail once they are in Canada.

US citizen partners and spouses can apply at the border crossing or consulate before coming to Canada. No job offer is required to apply. The application fee is $150.
Applying for a spouse/partner work permit in Canada

The permit will be issued for the length of the study permit of the student partner or spouse and can be extended with the study permit or work permit of the student (online).

When you extend your study permit using the online application system MyCIC, you can apply to extend the documents of all of your dependents at the same time, including work permits for partners and spouses. There will be a fee for each document requested.

If your partner or spouse will be applying for a work permit, but you are not applying for a document, the spouse or partner will use the paper application form, and should include the following with their application:

· a copy of the student's work or study permit

· a copy of the partner/spouse's permit

· a letter of enrolment with the application

· a copy of the official (your current institution in CANADA) transcript

· Proof of Funds

· a copy of your marriage certificate or declaration of common-law union

Note: If spouses or partners who have work permits choose to apply for study permits later, their work permits will remain valid but they may not be allowed to extend them.

1. Applying for TRV from outside Canada is the best option. In his application he should clearly demonstrate his intentions that he wants to stay temporary in Canada. The refusal under FSW will not affect his case if he convinces the VO about his temporary stay in Canada. He should show enough money in his bank statement so that the VO agrees that he is financially strong and will not be a burden on Canadian job market in coming days. He should show proof of ties to his home country which will help him in convincing VO about his temporary stay in Canada.

2. Once he enter Canada then he can apply for OWP and he will get it quite easily.

Please receive a warm Thankyou for suggesting me with your expert opinions.

Since it has been observed that applying for Open Work permit at this stage when wife is already in Canada, did not turned out to be a successfull experience for the applicant, because Open work permit always works when it is submited with the application of wife's study permit.
So we are thinking to go with TRV....First...and then OWP.
Just Pray for us...
