I have a serious question you guys. I was born when my mother was 16 so my grandmother was responsible for all the documents procedures. There was a huge conflict between my parents and this conflict has not been solved so in my birth certificate there is a blank field in front of father. Since then we've moved to another country and possibility of finding my biological father after 30 years is almost zero percent. I've provided this birth certificate with blank space in Express Entry profile and after almost for months I've got this message:

I am now completing the assessment of your application for a permanent resident visa. It appears that you may not meet the requirements for immigration to Canada.
I have requested you to provide additional family information regarding your spouse’s biological father.
I note that you have provided information birth certificate that shows blank fields about your spouse’s father.
I have already given you an opportunity to provide explanation regarding this matter via request letter.
Having reviewed your response, I am not satisfied that you are providing me with all the necessary information required to process your application.
In your explanation, you provided the following:
In my copy of IMM 5406 father info is indicated as N/A (not applicable). The reason is that there is no father details in my birth certificate and thus N/A for father information field in IMM 5406 form. Please find enclosed my birth certificate proving that.
However, I am not satisfied that you have provided enough information to continue processing your application.
According to the Immigration and Refugee Protection Act subsection 16 (1)
A person who makes an application must answer truthfully all questions put to them for the purpose of the examination and must produce a visa and all relevant evidence and documents that the officer reasonably requires.
I have concerns that you have not answered all my questions fully and provided me with the evidence that I require to completely assess your application.


And now the real question: what should I do? I have a step-father tho. We both share the same last name but he's not my biological father. I can't believe that after almost 4 freaking months in IP1 CIC wants to refuse my case.

You should have responded that you are unable to identify your biological father, unless you do actually have that information available, in which case you should supply it, even if it's not in the birth certificate.

And what about now? What if I send back IMM 5406 with my step father's name written in it?

I just noticed that the IRCC response is about your spouses biological father, not yours... Please clarify.

I'm the dependent, mate. My wife's a principal applicant. Let's say, I'm the one doing the immigration stuff. She has a higher degree and way more fluent in french and english. So this letter from CIC is pretty much about me.

If they are requesting biological father's information, they will not accept a step-father in lieu.
 
i didnt know they asked for birth certificates. wonder what triggers it.
I have no idea but it seems that it can destroy the whole process for those who have no a full family.

You had been given an opportunity to explain and they weren't satisfied with it. You can't send them any more documents as your case will be closed. You'll need to reapply and provide the correct information the second time around.

i dont think they refused his application yet. there might be one last chance.

Actually I can upload one more time. I've just checked my Express Entry profile. So I'm hoping to find a real decision right here. CIC's processing time is too long to wait 6 months once again.

Can someone post an instruction guide for IMM 5406? The only information about this form is completely outdated (2013 or older) and contains only posts from real people without any links to IRCC.
The real question right now is how to proceed to the next stage and not get refused by immigration officer? And what happens if I fill in my step-dad's name? Misrepresentation and 5 year ban or just refuse? Or maybe they'll finally start my background check?
I've just been thinking about placing biological father and I completely don't understand how do they plan to check if someone is really my dad. DNA test? Or some social engineering stuff like contacting with other people to figure out if information is true?
 
i think you should respond with a detailed explanation like you did in the first post and hope for the best. im pretty sure it will not be refused.

The only thing I know from my mother and grandmother is that there was a huge conflict between my parents and this conflict has not been solved so in my birth certificate there is a blank field in front of father. Since then I have never heard about my biological father. I have never seen him and I only know his name, not even surname, nor his date of birth, current marital status or address of residence, which are required in the IMM 5406 form.


As per Federal Law of the Russian Federation No. 143-FZ of 15 November 1997 “On Acts of Civil Status” (article 17 paragraph 3), at the mother’s will, there can be no entries about the father at all, which mean that simultaneous parental rights (in other words, for a person to have both father and mother stated in their birth certificate) only arise when both persons, married or not, are filing a joint application to be stated in the child’s birth certificate.
Unfortunately, this was not my case. After my biological parents (or to be more precise, my grandparents since parents were too young at this time) have had their conflict, the joint parental application I have mentioned above was not filed so there is no father data entry in my birth certificate at all.

After some time my mother’s married ____________ and we’ve started to live altogether: me, my mother, my grandmother and ______, but my mother’s husband’s never adopted me as a son – my birth certificate remains uncorrected or unchanged since my birth.

I certify that I have provided the truthful and complete information about my biological family in the IMM 5406 form so the original version of this form is correct. I’m ready to provide any additional information or documents at your request if you specify the type of those necessary documents.
