Question for my friend and her husband.

Quesion for my friend​

My friend and her husband got married 2 years ago in the Fall. They sent in their files in the Spring. She got a letter saying she was approved to sponsor a few months ago. They live in Toronto BTW. She got a knock on her door one day, it was immigration police or something like that - they were checking to make sure that her husband was there. He coincidentally wasnt home at that moment, but she was able to show them his clothing, bathroom stuff, pictures on the walls of them etc. that satisfied them that he was residing there. They informed her at that time that he needed to come turn himself in because there was a warrant for his arrest through immigration. He did, he went down and they just took away his passport and gave him a certified copy of it and told him good luck with his filing. Then they get notice about a month later that he is subject to a removal order again. They gave him this form that he had to fill out asking for refugee status - from Jamaica . Which we know won't be approved, but the lady told him to fill it out anyways because it'll buy him time and hopefully his CIC application paperwork will be ready at the same time. That form was sent away - far - i beleive it was sent out West somewhere. So they said that could buy him up to 6 months extra time. They figure that this happened because he came here on a VISA which expired around the time my friend and him met, they dated and fell in love. He didnt go back because he didnt want to leave her. They dated for about a year before deciding to marry because they love eachother and couldnt imagine parting. They said that during the time between the VISA expiring and him filing for his PR the removal order was put in process, then when he filed and they knew his address they were able to find him. That he should have filed earlier, but he wasnt engaged or married earlier. So its a "catch 22" I guess.

They have hired an immigration lawyer.

Anyone else have a similar story like this?

canadajamaica : Welcome to the forum. That story sounds like something you would see on t.v. but I have to say i've never heard such a story in real life!! They applied 2 years ago in the Spring and this is all happening recently?

YES! i am 80% sure that it was 2 years ago now yep. ya i know, how they showed up at their apartment was just un heard of! i have never heard of that either.

canadajamaica : Your capital Y.E.S sounded more like 90% sure but I appreciate your honesty! :p I guess if you were to stay here illegally that would be something you might fear would happen, but i didn't realize it really DID happen. It will be interesting to hear how that plays out. Keep up posted ;)

Well a similar situation happened with my friend. Her husbands visa expired and they got married after it expired. They hired a lawyer to help them get it all sorted out but it ended in him having to leave canada and go home. He still to this day isnt allowed back here. they said he can volunteer leaving or they will deport him, so he volunteered on leaving hoping he would be able to come back but he was denied ???

Mrs Proper : Wow. My husband was here on a work permit when we met. Believe me when I say the thought crossed our minds for him to not leave once it expired! Actually ..my husband is the most honorable.. by the book person I have ever met ..so I should say it crossed MY mind. He said he could never live like that, always watching his back and that we had to do things the right way. He's right of course but 8 months later... it's sometimes hard to admit to him. ;)

Oh my gosh - I'm scared for them. He is SUCH a good guy and if she loses him she'll lose IT! He is so supportive of her and her daughter and her new grandchild even! He is quiet and even tempered - energetic and helpful. He is not lazy, he does everything he can do for his new 'family'.

The immigration lawyer said that worse case scenario he has to go back and file that way. But what if they don't let him back? oh my!

I keep telling her it won't happen and him too. He isnt sleeping at night he's so worried. He didnt mean to stay illegally he just didnt know better really. He didnt really understand how it worked. He didnt have money to ask anyone for advice and got bad 'free' advice from cousins and friends I guess.

canadajamaica I think like in an situation..there are some horror stories.. but there are some success stories too. Plus they have enlisted in the help of a immigration lawyer so it may still work out for them.

Canadajamaica-welcome to forum! I know someone personally who was in the exact situation. Her husband over stayd his TRV and immigration found him and told him he either leave the country willingly or be deported. They chose to leave, she filed for him to come back and got through within 10 months. Please advise your friend to to go on own free will. My cousin was just telling me a story of someone who chose to be deported in 08 to avoid paying the plane ticket and until this day is still trying to get her husband here.

yes not all end in bad situations. The lawyer said he could file as well but immigration said themselves that even if he did file he would get denied. your friend could fight it if so be the case. Itll jus take time and alot of money ::)
FOr the sake of them i hope thats not the case cuz its not an easy road.
Lilmaya if he was here on work visa and you married him and his visa wasnt expired he woulda been ok hun, he couldve got an extension on his visa and stay while paperwork is being done. As long as your visa doesnt expire before you are married in most cases you are ok. Its when your visa expires is when things get more difficult

Mrs Proper : We did talk about trying to extend his visa but he would have needed a letter from his employer extending his contract which had ended after 2 years. We didn't look much further as my husband has a daughter in Jamaica that he wanted to spend some time with and when he came here he hadn't intended to move to Canada permanently so he had some things to wrap up. His employer offered that once he returned for 3 months (min) they would try to bring him back on a new contract so we were pretty certain one way or another he'd be back soon..... :(

Mrs Proper- once again KG has proven to be unpredictable! Like you said lets hope for the best regarding Canadajamaica's friend! Personally if I was in that situation and was denied I'd be making plans to move to JA.

My girlfriend had same situation, her man was actually thrown in jail! Once released they then had about three impromptu visits from immigration popo, to be sure he wasnt wrking, and resided in the home.. it took over two years, BUT he is NOW a citizen.. No one ever wants to go through such horror.. never over stay your visa.. My very good friend has done so, he is doing an application for refugee status.. he will likely be deprted eventually.. but you never know!! gotta keep the faith!
