hi
I need expert help as i search all over the internet but couldn’t find any authentic info even on cic website. So here is the situation:
My mom’s( citizenship= Pakistani) visitor visa is going to expire on 19th june 2019 and in march she is flying to Australia to my brother and afterwards she planning to visit me back n forth on visitor visas from Australia to canada and then back to Australia. Now is it possible she can apply for a new visa before expiry of her current visa so when she planning to travel back and forth in March- Dec from Australia to Canada she won’t have to go back to Pakistan in between to apply for canadian visitor visa as she must apply for visitor visa from her country of citizenship.I know she can extend her stay once get here even after expiration of current visa but still again when she has to go to Australia and then coming back to canada she will have to wait for new visitor visa to be approved so we want to cut that time by applying in advanced for a new visa as my brother is now in Pakistan for few months so he can gather all documents for my mom who is senior otherwise she has to deal the visit visa application on herself which would be difficult for her .Or even is she can apply for supervisa before expiry of her visitor visa ??
Appreciate any response in this regard
Thanks

1. She can apply for a super visa even when her TRV is still valid. That said, a super visa may not be granted if she intends to stay for less than 6 months on the initial visit.

2. Applying several months in advance for a new TRV could result in the application being refused. Do consider the estimated processing time for Pakistan + factor in a few more weeks.... as the 'ideal' date for applying for the new TRV application

So that means if processing time for Pakistan is 3-6 months then to be on safe side applying in February can give her chances of approval for supervisa ?and she will be eligible to apply for supervisa from citizenship country (Pakistan)in February even though visa going to be expired in june2019?

The current processing time for super visas from Pakistan is 101 days. This is only an average estimate.

Your mom may want to submit an online application for her super visa + complete her medicals upfront without waiting for a medicals request from IRCC.... shortly before she leaves for Australia.

She can submit her passport to the Sydney visa office if she is in Australia when she gets a passport request..... or to CPC-Ottawa if she is in Canada and if she has entered on her current TRV.

Her TRV will be cancelled when the super visa is issued i.e. she won't have two valid visas simultaneously

Sorry to bother again but I came across few questions::1) like she can submit her biometrics in Australia as she will be applying from Pakistan right before she leaves for Australia so obviously she will be getting notice to submit biometrics while in Australia,so can she do that like to submit biometrics in Australia??
2) Also how long in advance she can have an upfront medical check up before submitting application?? Like if she will be submitting application in March first can she have upfront medical done in February mid?
3) is it possible if she has medical done in feb mid and 1 week after she left for Australia so can she submit her supervisa application online while staying as a visitor in Australia( while medical done in Pakistan)? As We are trying to minimize refusal chances as of applying in February which is 4 months advance of her current visit visa expiry( 19June 2019).
Please advice

Would she be applying for a super visa or for a new TRV? IMO, her intended short stays will not do justice to a super visa

She will get the Biometrics Instruction Letter within 24-48 hours. There are cases when it has taken a bit longer.

IMO, she would probably confuse the visa officer/IRCC for her ties/country of residence if she follows through with the plan you have suggested:
1. Medicals in mid-February in Pakistan
2. Apply online
3. Biometrics in Australia
4. Passport submission in Australia

Do keep it simple. She can do her medicals upfront a few days before she applies online + given her biometrics when she is still in Pakistan.

Although it is doable, I cannot see the logic in doing this because she will leave Pakistan in March.

IMO, you're complicating her application. Also, we have seen a handful of cases where super visas were granted months/years before the expiry of the parents' valid TRVs.

It's okay to switch between visa categories this way (TRV to super visa). Your mom is not applying for a new TRV several months before her current TRV expires.

I would focus on her medicals + proving you meet LICO + proving she has reasonable ties to Pakistan

Uhh ok that’s more clear now as we are doing those things to make sure if we are not applying too much in advance before expiry of visitor visa so now it’s all sorted and yes we will then b doing medical and biometric n submission of super visa application before she will be leaving for Australia as it will be more easy and simple plus strong ties to home country only the confusion was of applying 3 months before expiry but now it’s all clear .Thanks alot:)

My suggestion is:
Consider her entire application as an in-Pakistan applicant (medicals, application, biometrics) = Better chances of a super visa approval, or
entire application (start to finish) as an in-Australia applicant (probably lesser chances of an approval because she would be a visitor in Australia).

If you want to minimize the risks, you may want to have her do the super visa medicals (sort of like practice medicals) at one of the panel physicians right away. This way, there won't be any surprises when she gives the actual medicals in March
