New Study Permit still not mailed, Expired SIN number, Can I legally Work?

Hi all,

I am currently having some trouble with Study permit and the SIN number I have with it.

I am now a student at a University in Canada and I am working as a Teaching Assistant on campus. My SIN number, which I applied in together with my current study permit, is about to expire next month.

Since my study has not finished, I applied for a Study Permit Extension on April. IRCC made a decision on May 19, and mailed me a new Study Permit with validation date till Feb 2019. However, I still didn't get my Study Permit mailed to me due to some reason with the IRCC system, and my SIN number is about to expire. Can I still legally work between the time where my SIN number gets expired and the time when I get my Study Permit mailed to me (and getting a new SIN)?


I do know that according to Service Canada:

"If a temporary resident applies for renewal of their work or study permit and their permit expires before a decision is made, paragraph 186(u) and section 189 of the Immigration and Refugee Protection Regulations provide them the right to continue working or studying under the same conditions while their application for renewal is being processed, as long as they remain in Canada. This is referred to as "implied status." The temporary foreign worker will have implied status until a decision is rendered by IRCC."

However it seems like the implied status refer specifically to situations where "their permit expires before a decision is made". However my permit expires after a decision is made but before the document of the decision related to me is mailed to me for me to renew my SIN number......

The best thing to do is probably go to Service Canada with the notification you received on the study permit renewal and see what they can do. Also check with the international student office at your school I am sure they have dealt with this issue before.

My friend tell me they've done so before and Service Canada would require the actual study permit for SIN renewal...

Yes, you can continue to work. Renew your SIN once your new study permit arrives.
