I need accurate information about conjugal relationship and chances of success in the application for a partner. My long distance partner of 1 year is applying for PR and is expected to get it. He has a good score and sought after profession. We are looking at applying for conjugal PR after he gets his PR.

Situation: We are not living in the same country, or else we would be married. But we are from the same region and culture. We are exclusive and have shared many things jointly including financial support, bank statements, communicated the relationship to church elders for counseling, ticket bookings for professional events paid by one of us for the other, hotel bookings and more. We have taken medical tests and released results to each other, and have shared info you would not share unless you were looking at someone for an intimate relationship or marriage. We have feelings for each other, and have had our ups and downs but still stuck together.

Records of our communications are available on chat apps, emails and cards. We have also given each other gifts. Our friends, church leaders and families know about our relationship.

We are unable to get visas to see each other or get married in each other's countries due to immigration difficulties. There is no criminal background involved, the circumstances are just extraneous.

Can our relationship pass as conjugal? And when my partner gets PR, can a conjugal Application be filed for me? We are heterosexual.

You don't have to have sexual relations to have met in person.

I think you are very unlikely to get a visa based on a conjugal relationship with someone you've never met in person before. Is there a reason why you cannot both travel to a third country to meet and get married?

My question had nothing to do with sexual relations. I was asking if you had met in person. Unfortunately there's no chance the conjugal application will be successful if you have never met in person. You will need to find a way to meet and get married if you want this sponsorship to work. If you have tried applying and cannot obtain a visa to each other's countries, then focus on obtaining a visa to a third country where you would be able to meet in person and get married.

I think you are very unlikely to get a visa based on a conjugal relationship with someone you've never met in person before. Is there a reason why you cannot both travel to a third country to meet and get married?
I didn't think you meant sexual relations. But I have read about this sponsorship that relationship can also be proved based on physical, relational, and emotional attachment,
Plus shared things like bank accounts, travel together if any, letters, gifts etc.

I live in US but can't travel out now as I await adjudication of my own complicated immigration petition. Not US PR. The partner lives in an African country and has not been able to get a visa to the U.S. either. It was denied, although it had nothing to do with this issue.

I read about the conjugal PR not needing being in the same location as partner. The reason WHY conjugal partner PR was created was to cater for people who did not meet the requirements of Spouse or Common Law Partners.

Going to get married in a third country is an option, but may further complicate our immigration situations and we may lose out on a future together in Canada. Besides, it's not a straightforward case either, as you need to establish the marriage is bonafide and can actually get denied or delayed too. It's best if my partner gets PR in Canada and we apply for conjugal, at least from what I researched. If the relationship can be proved to be genuine.

We can only meet in person if he gets PR, as at that point, the risk would be worth taking.

You've never met before. Don't bother with a conjugal application. You'll waste years of your time.

I've never seen a conjugal case succeed without the two individuals meeting in person at least once. If you go this route, I think refusal is guaranteed.

My recommendation is that you wait until your partner has PR in Canada. Your partner can then apply for a US visitor visa which will hopefully be approved. Your partner can then travel to the US to meet you there in person and marry you - then return to Canada and sponsor you for PR. This is the best and most realistic plan.

I've never seen a conjugal case succeed without the two individuals meeting in person at least once. If you go this route, I think refusal is guaranteed.

My recommendation is that you wait until your partner has PR in Canada. Your partner can then apply for a US visitor visa which will hopefully be approved. Your partner can then travel to the US to meet you there in person and marry you - then return to Canada and sponsor you for PR. This is the best and most realistic plan.

Honestly I think applying conjugal May be way too complicated and disappointing for you. Understandable that travelling to a third country to marry would be difficult, but from what I’ve heard, if there’s any possibility of getting married, they expect you to do it.

I think your best option is to wait until he becomes PR in Canada, and that way I believe he won’t need a TRV to visit USA. You can get married here or there and then do a spousal sponsorship, and you can apply for OWP and do an Inland application if the goal is to be together during the process, which is much easier to do and way less scrutiny.
