New Family work permits on 2023

Guys,

Just a question, since they will be introducing this new program/policy this coming January 2023, does this mean this will replace Spouse Open Work Permit (c41 exemption) for spouses of high-skilled temporary foreign workers?

Or will they keep these 2?

You're asking questions about IRCC policy which haven't been announced yet. So no one here is going to be able to answer.

Safe to assume they will retain some sort of spousal open work permit program. Whether that's the current programs or new programs is anyone's guess.

For now since there are no formal announcements yet, can I still submit my SOWP under C41 exemption?

My wife's NOC was 3413 and now TEER 33102, are we eligible now?

I see it now. We are still waiting for our work permit approvals I wonder if we could apply for our dependent children as soon as we get our visas or do we wait til we land and start working?

They’re employed in a low-skilled occupation (TEER 4 or 5 of the National Occupation Classification system) at the time of the family members’ application.

No your children and spouse are not eligible at this time. It is being phased in and Phase ONE is high skilled workers. As per the link above,

Who is not eligible at this time
Spouses and dependent children of workers in a TEER 4 or 5 job under the low-wage stream, the Seasonal Agricultural Worker Program and the Agricultural Stream of the Temporary Foreign Worker Program are not eligible at this time.

You may find the stream or program the principal foreign worker has been hired under by looking at the labour market impact assessment approval letter provided by the employer.


You can see the IRCC news release. As announced, phase 1 of this new temporary policy will now come in effect beginning January 30.

Phase 1 – allows family members of employees who come to Canada to apply for an open work visa through the high-wage stream of the Temporary Foreign Worker Program or the International Mobility Program.January 30, 2023
Phase 2 – Following consultations, the legislation will be expanded to include family members of employees from the low-wage stream of the Temporary Foreign Worker Program.To be decided
Phase 3 – Consultation with agricultural partners and stakeholders will be conducted to examine the practical viability of expanding the measure to cover family members of agricultural employees.To be decided

Hi! If my WP has been approved and I have not landed or don’t go to canada yet. Can my spouse apply for OWP? so we can go together once his owp is approved?
