In the "background declaration" form, it asks if the applicant has ever been denied a visa..technically, my husband was not denied a visa but his file was put under administrative processing for many years (2006-2010). In 2010 (Feb/Mar), he went to the US embassy in New Delhi and voluntarily cancelled his petition since he was tired of waiting for their decision and he had to concentrate on his business in India.
My concern is, since he had cancelled it on his own, he should just mention that he did cos if he doesn't, CIC might question him since he has a stamp on his passport that says "US VISA IMMIGRANT Application received"
