Hello Members,

I am posting it here as in the work permit section nobody could help.

My Situation:
In-land Family sponsored PR application along with Spousal Open Work Permit Extension Application as per Spousal Open Work Permit Pilot Program,
submitted in the same envelope in JAN 2021 to Mississauga, ON.
Current Spousal Open Work Permit expired in FEB 2021.

My Question:
I am assuming I am on Open Work Permit Implied Status.

I found on IRCC website that Due to a temporary public policy about COVID-19,
"On implied status, work permit applicants don’t need to wait until their work permit application is approved
to start their new job or work for a new employer. They just need an email from IRCC that says they have permission to change jobs.
And as always, open work permit holders can change employers at any time."

https://www.canada.ca/en/immigration-refugees-citizenship/services/work-canada/permit/temporary/extend/change-jobs-employers.html

https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/service-delivery/coronavirus/temporary-residence/work-permit/changing-employment.html

1. As I did not work yet in Canada till now since my arrival, Can I start working for a job while I am on my Open Work Permit implied status now,
if I receive a job offer? - As per the new temporary public policy about COVID-19.

2. Do I need any permission email from IRCC to start working for a job now? Because I held an Open Work Permit
which has already been submitted for an extension, I should not need any permission email from IRCC and according to
the new temporary CONVID-19 Public Policy I should be able to change my job or employer any time? is not so?
Please let me know my understanding is right or not.

I have these confusion as in those articles I did not find a clear sentence saying that "Open Work Permit implied status applicants can start working for new job or new employer without IRCC permission email" - as per the new temporary public policy about COVID-19.

Thanks for your help.
Regards,
Neev.

I'm confused by your dates and details. How are you applying for an OWP extension along with the spousal sponsorship application?

Hello,

Thanks for looking into my issue.
I was able to apply for the PR and also the work permit extension in the same envelope by the below policy.
I applied for both the application before my current Spousal Work Permit expired. Please let me know if you need any other information.

I'm familiar with the policy. What confuses me is the fact you applied for an extension. You are supposed to submit a new open work permit application (along with the spousal sponsorship application) - not an extension. That's what doesn't make sense. Are you 100% sure you applied to extend your work permit vs. applying for a new open work permit?

You have implied status for now and can work. What I'm not sure about is what IRCC will do with the extension application given you were supposed to apply for a new open work permit. I'm not sure if they'll process that or refuse it. If they process it, then you're good. If they refuse it, then you'll end up without status in Canada, will need to stop working, and then apply to restore your status.

Thanks for your reply.

Actually before applying for the PR application and the work permit extension I asked in this forum
and a champion member advised me to submit the IMM5710 which I believe the extension form
along with the PR application.

Also, I paid an immigration lawyer to prepare for the 2 applications. I never told them which form to choose.
I just said prepare the PR application and "Open work permit pilot program" so that I can remain in Canada.
They sent me the IMM5710 to fill.

Now if both the forum champion member and the immigration lawyer did the same mistake then what can I do.
They anyways know better than me.

Now as you mentioned it might be a mistake then I now again have to research about whether it is wrong
and what can I do to submit a visitor record online now.

Please give me your opinion on this. Thanks!
