Hello Everyone,

I am little confused here and hope someone can guide me in the right direction. Worse part is, even Immigration Consultants are contradicting with each other.

I have completed 1 year Post graduate Diploma from a community college and since than working as a General Manager (NOC 'O') since last 12 months as a full time employee on an Open Work Permit (After completing my studies, 1 year open work permit).

As per the new policies, 1 year of experience is required to apply PR under CEC. However, I am confused whether I am eligible to apply under CEC given the fact I am working on an Open Work Permit after completing my education.

Refer to the changed checklist (Item 10) > http://www.cic.gc.ca/english/pdf/kits/forms/IMM5610E.pdf

Applicants who are authorized to work in Canada without a work permit are eligible to apply under the CEC, but must provide documentation with their application establishing that they had legal temporary status in Canada during the period of qualifying work exp (eg. copy of visitor record).

You are good to go.

Simply put, I think the new rule, regardless of the unchanged graduate stream, paves the way to PR for those such as yourself. The point of the lower requirements is to easy the transition for those already in Canada, which would include you by default (based on experience).

Concur with Andy2109 and think you should go for it. If you are still unsure, you can always give CIC a call.

Thanks Andy2109/CEC2013,

I did called CIC and even they did gave any definite answer. In the check list, it says "Applicants who are authorized to work in Canada without a work permit are eligible to apply under the CEC" however, I am on an Open Work Permit. I am wondering if the above mentioned line is referred to people on Tourist VISA however eligible to apply CEC..... I am confused...

Work permit is same whether it is open(e.g. dependent, pgwp etc.) or closed(sponsored by company) one. You are good to go with your current open work permit as long as you meet CEC requirements. You need to provide the supporting documentation that you meet the requirements of CEC.

Open work permit is not a problem. There are other requirements (a minimum of 12 months of full-time experience in a SKILLED occupation) that may be difficult to meet. For example, if you only have a 1 year PGWP, you would have to begin working on the day you received the permit to the very last day of the permit to meet the 1 year experience requirement. Most people who get PGWPs take some time to find employment, and even then, it may not be skilled.

Here is another question:

Before, the 12 (or 24 months before the recent changes) must have been done AFTER you graduate.

Is it possible to qualify for CEC if you were working (with a valid, legal work permit) WHILE you were studying? I am trying to find out whether they changed this rule or not.

It is still not acceptable..I remember reading it in OP...it would be nice if they allow that..

Requirements for applicants
Work experience

To apply for permanent resident status through the CEC, you need at least one year of full-time experience (or the equivalent in part-time work) as a skilled worker in Canada. Full-time work means at least 30 hours per week. The one-year work experience must have been obtained within the three years preceding the date your CEC application is received.

To work in Canada after graduating, your best option is to apply for a post-graduation work permit. Information on obtaining a work permit is available on CIC’s website at cic.gc.ca/study. These permits may be valid for up to three years. There are no restrictions on the type of work you can do or where you do it, but to qualify for the CEC, remember that at least one year of your work experience must be in a skilled occupation (see “skilled work experience”).

It is also important to note that work experience you may have acquired as part of your academic program, such as an internship or a co-op placement, does not qualify under the CEC. Part-time work you may have performed during your studies does not qualify either.


But what about Full time work during studies?????

You must meet certain requirements to be eligible to apply for permanent residence under the Canadian Experience Class. For example, you must:

apply while working in Canada, or within one year of leaving your job in Canada and
be either:
a temporary foreign worker with at least two years of full-time (or equivalent) skilled work experience in Canada, or
a foreign graduate from a Canadian post-secondary institution with at least one year of full-time (or equivalent) skilled work experience in Canada obtained after you receive your Canadian degree, diploma or certificate.

To find out if your work experience qualifies you under the Canadian Experience Class, see Jobs and their National Occupational Classification descriptions. Follow the instructions to find the category on the National Occupational Classification reference list that matches your work experience.

There are other requirements you will also have to meet:

Requirements for temporary workers
Requirements for graduates

If you meet all the requirements, your application will be assessed as follows.

If you apply as a temporary foreign worker, your application will be assessed on:

your work experience and
your ability in English or French.

If you apply as a graduate, your application will be assessed on:

your education;
your work experience after you obtain your degree, diploma or certificate; and
your ability in English or French.
