NEW CAPS ON F.S.W. IMMIGRATION

Can any experts explain the new "CAPS" on F.S.W. Immigration. Will these CAPS affect the ones who applied before the new rules?

I am not an expert but here is what i think

1) The CAP does not apply to pre June 26, 2010 applicants
2) The CAP is only for 29 Occupation List applicant and AEO applicants are exempt

They will process a maximum of 1000 of any NOC for FSW.
They will process a maximum of 20000 for all FSW1.
By process, I mean okay the application at CIO.

In other words, if you apply under an NOC and they have okay'ed less than 20000 FSW1 application and they have okay'ed less than 1000 in that NOC, only then they would let yours proceed to the visa office stage.

Maaties, I think by process they mean it is eligible for processing at the local visa office. So CIO will just do the regular background screening.

Nothing, I think. Hopefully the quotas do not affect the old applications.

No, I think you are right, they will do it at CIO and the meter there will keep ticking as there will be rejections at the local visa office as well and that might get CIO working again in the 12 months period.

It would be good if they do eligible for processing only at CIO. It is a waste of time.
By the way, do applicants have to send full application to CIO or only the IELTS?

Only IELTS to CIO. Full application will go to local visa offices only. They have very less strength of visa officers at Nova Scotia and are planning to hire more. But since many applicants failed to provide proof of language ability at the right time so they have decided to make this norm more strict.

Check this out:

"Make sure to consult the document checklist (IMM 5612) and the Visa Office specific requirements (supporting documents) for your country to determine what documents you will need to provide. If you are not prepared to submit full documentation to the CIO do not apply now. If you do not submit a complete application with the supporting documents, your application will be returned to you."

Rocky - it could mean that they will stop the eligibility check at the visa office (even though they haven't mentioned it). This might reduce time by a LOT.
Both IELTS and police certificates/clearances to the CIO as part of the application process. I presume the above means it is true for all documentation.

Yah indeed it is. As arranging PCC and IELTS was the reason for delay for many applicants and that is why they have introduced this clause now and definitely it will reduce a lot of time and backlog of people who have applied before 2008

what is the meaning of "The CAP is only for 29 Occupation List applicant"? is it when 1000 application is full for 1 year they reject application 1001? just some body help me i am so confuse... if it is 29 occupation and 1000 application for each will be 29000 also
I need someone explain about if my applicaion going to receive by cio after 1000 application filed??? thanks

They weren't specific on what they would do with 1001. Maybe they will reject the application, maybe they will push the application to the next year. Either way, they are doing this to clear a backlog of old applications, but I have a feeling it is going to create a bigger backlog for them in the long run.
