new baby born overseas for PR - Leon plz advice

Dear all,

I need your advice as soon as possible..

now this is my case, they request medical tests for me and my spouse on aug 2010, but i received the letter on oct 2010, and i sent them immedialty, at the same time, i had a new baby on aug 2010, and i sent my updated documents including her fees on oct 2010.
they sent me medical request for my daughter on may 2011.. now before two weeks they asked me to send my passports and RPRF to london office asap because my visa will be expired on oct 2011 due to medical tests expiry date.

my problem is that im pregnant again and my due date is on 1st of dec 2011..so we were planning at the first time to go for landing for a week then come back for delivery and arrange our things in our home country then go back to canada maybe after a year or less..

I was checking how can we sponser our child if he was born outside canada.. it looks like a very complicated thing! you cant guarantee issuing TRP or TRV for your child and I cant stand the idea of letting one of parents go to canada alone to sponsor the child and it may take more than 6 months!! this is somehow impossible for me to live apart for all that period of time..

so im wondering if its possible to contact my visa office and letting them know about my pregnancy. so if they can wait till i give birth then i send the updated documents and new medical tests for all of us.. is it ok for them? can they change their decision in our immigration? or its only a matter of time after i sent the new medical tests..

or you advise me to go and give birth in canada??! my problem is Im totally new to canada! i have no one there to help and i already have a baby girl who is only 1 year.. and i cant imagine how my life would be with a new baby and a toddler alone with my husband..

I have to decide what should I do in two days so please help me.. and tell me what is best to do..

Yes, it is tricky to sponsor a child for PR if it is born overseas. Many have been refused TRV's for a child, some have been granted TRP's in order to take the baby with them but in some cases one parent has gone to Canada alone to deal with the sponsorship.

If you are going to have the baby in Canada, you should at least pick a province that does not have a waiting time for health care so your delivery will be covered. That means you should not stay in Ontario, BC or NB. Anywhere else is fine.

If you want to try to ask your visa office to add the new baby again and wait with the visas, you will have to talk to them about what they are willing to do.

about the health insurance.. I tried to c if the health insurance is covered in Manitoba from the first day your arrive.. but its mentioned in their website that also you have to wait 3 months!.. and for Alberta I have to be there at least 183 days of 12 months! and I dont think i could do it in the meantime!.. what about the private health insurance? do you have any idea about it? does the pregnancy and delivery covered? what are the best companies?

About asking the visa office, is it risky to wait for another visa or its normal and its only about the medical tests??
Im only worried if I ask to wait that they will get our application to an endless waiting time..

Manitoba and Alberta only ask for 3 months waiting period if you are moving from another province. If you are moving from another country, you are covered right away.

There is no private insurance that will cover you for pregnancy and childbirth when you are already pregnant. They would make no money if they insure you, knowing that they will soon be paying $5000-10000 in medical bills for you.

You will have to talk to the visa office if you want to know what they are willing to do for you or what they suggest.

The best option for you depends on what you want to do. Nobody else can tell you that. Only you can know if it is important to you to have the baby in your home country vs. Canada or if it is ok for you if you and your husband have to be apart if he has to go to Canada and sponsor the baby.

I'd say go to Canada before the due date, going either to a province that will cover you right away, or going at least three months ahead to a province that won't. Give birth there. You then won't have to sponsor the baby. You can then move back to your home country once you and the baby are able to fly, so you can be with your family and friends for the first year or whatever. Just make sure to return to Canada before your PR 'elapses' - you have to be in Canada for 2 years out of evey 5, but you can land, stay for a while, then go back home for a year or two.

Effective January 1, 2009, Albertans are no longer required to pay AHCIP premiums.

If you only landed in B.C you would be considered moving from out of country in which case your
Alberta Health Care Insurance Plan would start the date you arrived. if there are any hospital visits
they could be possibly retroactively covered to the effective date,

However we can not confirm that you and your spouse will be eligible for coverage
until we have viewed the Canada entry documents. Alberta residents
from outside Canada must provide a copy of their current Canada
entry document to determine their eligibility for Alberta Health
Care Insurance Plan (AHCIP) coverage.

Alberta Health Care will provide six months of coverage for you and your spouse
if you intend to make Alberta your permanent resident and the appropriate
papers are received. Acceptable immigration documents for the six months
coverage are Canada Custom stamp in your passport upon entry into Canada
or a visitors visa issued in Canada. Other acceptable immigration
documents are permanent residency card, a twelve month work authorization
or a student visa.

sorry for asking lots of question.. but I need to know what is the process after applying for a TRP and getting it.. what sould I do next? is it an easy process or a complicated one? how long does it take to get the PR for my child?

also, if one of the parents has to go to canada and sponsor the child by himself? how long does it take to sponsor him? when can we join (me and my kids) my husband in canada? after finishing all the sponsor process??

As you can see the post below, the process might take as long as 20months and complications of getting visitor visa for the baby to come to Canada. So, it is better to deliver your baby in Canada to save the processing time and your child would automatically be Canadian citizen:

As to your earlier concerns about you have no one in Canada to help and already have a baby girl who is only 1 year.. and cant imagine how life would be with a new baby and a toddler alone with husband.., I had a friend delivered and raised her baby all by herself in Vancouver BC (She was new there, but has relatives in Markham, Ontario). So this wouldn't be an issue.

now what about sponsoring child from inside canada if one parent go to canada and sponsor.. what is the procedure? for whom i have to apply for sponsoring? how long does it take? the child has to be outside canada all the period or he can be in canada after certain time of applying of sponsoring even if its his PR visa is not issued yet..

if my child has TRP and could go to canada with me.. then when I arrive canada,should I apply for mississauga office as he is living abroad referring to the visa office responsible for his country of origin? and I fill the forms of application to sponsor a family member who is not living in canada?

The procedure to sponsor the child is the same whether the child is inside or outside Canada. There is only an inland procedure if you are sponsoring a spouse (with or without kids) but if you are sponsoring a baby, you always use outland so yes, you would use the outland forms and mail them to Mississauga.
