New baby born during my citizenship application

Hello..

I've applied for citizenship back in Dec 2014 and its in process right now.. my wife was pregnant during that time and he was born a month ago, and of course he wasn't included in the application at that time, do i have to inform the immigration that we have a new born now?.. or its not required ?

The baby was born here in Ontario - Canada.

No need to inform CIC. The new born is a Canadian citizen. No impact on your application.

Are you sure about that? Following are on the application form:

"Complete the information below for all children who were under the age of 18 in the four (4) years before the date of your application including those who are already Canadian
citizens
(if applicable)."

Also:

"I agree to advise Citizenship and Immigration Canada if any information on this form changes before I take the Oath of Citizenship."

I would say that if he was completing that application AFTER the child was born, he should have included that child's details.
Which also means that the information has changed, and he should notify CIC.

His wife was pregnant when he applied. He didn't fail to disclose having this child, because at the time this child was not born. The child is one month old and the application has been submitted ~6 months ago.

I'd agree on informing CIC based on that.

You need to inform them, as it is required. Just send them a case specific enquiry email (or fax them). Include your client ID and copy of the baby's birth certificate.

There are no issues, just need to send them the information, that's all

Thank you guys for the help, I was confused myself.. the information under the application itself is a bit confusing.. I will go ahead and inform them
I'm just afraid this will delay things.. but I guess its better to inform them and be clear about it.

If, instead, you want to send a fax, you can do that too. I think there is also a fax number (I dont have that). If you call the call centre, they should be able to give that to you

I realize that. I was saying, that IF there is a citizen baby at the moment of application, it should be disclosed.

On his application there is no baby (because it was born after the application).
If he was applying today, he would have to include baby in the application.

Therefore the information in the application has changed, so CIC should be notified.

Yes, I am sure the OP does not need to report the birth of a new child while the application is pending.

What information has changed that needs to be reported?

A child born after the application is made (citizen or not) is not a child who was under the age of 18 in the four (4) calendar years before the date of [the] application.

Some information in the form is dated, based on information existing up to the date of the application. It never changes. It may have been incorrect, in which case a correction should be made. But it never changes.

Who the applicant's dependent children were during the relevant four years (six years in the current form) never changes once the application is made. No need to inform CIC if a listed child is no longer a dependent, whether due to age, marriage, or even death. No need to inform CIC if the applicant has any additional children after making the application, whether through adoption or birth.

This is similar to changing employment: no need to inform CIC if the applicant gets a new job. The work history in the application is indeed history, and the application does not separately ask for current employment.

In contrast, there is information in the form which is not dated, like place of residence, telephone numbers, PR status in other countries. This information can change and the applicant is obligated to inform CIC of such changes. This includes the applicant's "work number," by the way, so while the applicant does not need to notify CIC of a job change, if the telephone number for work changes, that is a change that needs to be updated.


Note: it makes sense that CIC wants information about dependent children during the relevant residency time period because where the applicant's dependents live is a key indicator of where the applicant actually resides, and the school records are definitive documentation showing where they have been residing. If an applicant has dependent children who have been living abroad, going to school abroad, that does not disqualify him or otherwise preclude a grant of citizenship, but it would be a big factor in how CIC assesses the applicant's accounting of residency/presence. It would not be surprising to see revised RQ forms under the new requirements which specifically ask for this sort of information to date since under the new requirements the applicants place of residing and ties to a place during the processing time is relevant (given section 5(1)(c.1) in the revised Citizenship Act).

In any event, the birth of a child after applying does not change any information submitted in the previous application form, so no need to inform CIC.

I had my test three days after my baby was born. When I asked the examiner if I had to notify CIC about the baby, she told me, "Was he born in Canada? Then he is already a citizen, you don't have to inform us". Just in case, I called CIC a week later to inform them, but it was mostly an excuse to inquire about my spouse's application---she had to skip the test because she was recovering from childbirth. I was told the same, no need to inform them (I ended up not inquiring about her application, because while I was on the phone with the agent, the mailman arrived with her new test date. Lucky.)

Now, when I had my exam, I presented my wife's discharge papers from the hospital to explain why she missed her test date. They added that document to her file, so the information about us having a new baby was in the file. If you have your test date soon, just bring the documents with you and offer them to the interviewer. Otherwise, it seems to be up to you. You can use it as an excuse to inquire about your application ("I mailed/faxed/whatever these documents a few weeks ago, can you see if they were received?"), and to further support the claim that you are living in Canada.
