Need your help.. Marriage does it make a difference?

Hey, I'm Alex, I'm 20 and i'm British.

I started dating a Canadian girl over a year and a half ago,, it has been a nightmare because of the visa's, we are planning to start the application for common law partner sponsorship very shortly, but i want a question answered.. would it make any difference if we got married in Canada before, would it speed things up? make things easier? We just want to get on with our lives. Waiting another 6 months to be able to work seems crazy, its totally absurd.

I don't think it does make a difference though if it does, please save me from my nightmare and tell me, the sooner i can resolve this the sooner i can get on with things and start making babies. LOL

So have you managed to live together for 12 months? Because if not, then you don't qualify to be common law. Marriage will not speed things up for you if you qualify as common law. It's the same application.

Well there have been gaps while we have flown back and fourth to each others country but on the whole we have been together all the time, though i have returned to the UK in the last week for 2 months because my visitors visa expired does that mean i need to get back there now :S

If you have not really lived together in one place for 12 months, just been going back and forth visiting, it might be harder to prove a common law relationship so maybe better for you to get married. I think you will survive the 6 months wait and live happily ever after. There is nothing else you can do about it.

I do have a question, how do they expect to stay together for 12 months straight if the visa for a visitor only lasts for 6 months?

You can apply to extend your visitor visa, as long as you have sufficient funds and a return ticket (or the funds to buy one) and a valid reason - I extended mine for over 3 years in total (I am English too) and the reason I put on my application was that I was in a relationship and wanted to persue it.

Once in Canada and in a position to apply (through marriage or common-law) you could apply for in-country processing and could then apply for and receive a 1 year visitors extension, you will also receive permission to apply for a work permit once your sponsorship approval (1st stage approval) has been given. Alternatively you can apply through London as an external family applicant and apply for a work permit at the same time providing you meet the marriage / common law requirements.

Well this is my plan... I was going to go back to Canada in December.. book a return ticket like i always do, get married sometime next year probably before my six months is up. Get my partner to start the sponsorship application and then when her part is done continue mine from inside Canada, and stay during my application process.

Are you saying that i can get a work permit before the PR application is finished.. i can apply for one after my partner completes stage one?

If you do an inland application, you fill out all the paperwork together, the sponsorship application by your partner, your application for PR and your request for work permit when you get first stage approval, then send it in and in about 6 months when your first stage approval comes through you will get your work permit. Getting the PR with inland application can take 1-2 years.

Another way is to apply outland, you still send in all the documents at the same time, the sponsorship is then processed first and takes about 7 weeks and then the file goes to the UK and average time there is around 4 months and after that you get your PR. You would have to go to the UK though if they want an interview.

With inland application, you are not advised to leave Canada while your application is being processed because if you are for any reason denied entry, your application is gone. With inland, you also don't have the right to appeal if you are refused. With outland you do.

If you think Canada immigration is too hard for you, you can look into your partner immigrating to the UK instead but I'm not really sure that is any easier.

Canada, is what i have chosen and i stand by it. I will return to Canada and my partner will start the application, and hopefully i will be working in six months, its been hard not working for such a long period of time and i need to get back into the swing of things.

Is there anything else i should know? Will it make much of a difference where we get married, we plan to do it in Canada anyway..

So Get married, start application .....>>> 6 months down the line hopefully start working. I don't want to do outland, i don't want to spend more time away from Tara, and we cant afford to keep coming back to the UK

It doesn't really matter where you get married. Outland application also does not mean that you have to go back to the UK unless they want an interview. Many people prefer outland because it gets you the actual PR faster and because you have the right to appeal it if you are denied but it's up to you. Good luck.

So with an outland application, the only difference is that i could be called back for an interview? This may sound dumb and I'm sorry if it does, does that mean i have to apply from the UK, wait for my partner to do her part then apply from here, and then fly back over.. I reached the point where i have had and heard so much information i need it planned out in my head. Step by step.
