Hi guys,

I'm seeking your advice about the situation of my brother he's a doctor and permanent resident of canada since December 2011, he stayed for a month back than and had to go back to finish his 3 years of doctorate option to become pediatrician, now he has one more year to go, march 2015 he's planning to come to canada and stay for good, by then he'll not meet the residency obligation of 2 yrs (3 or 4 months short, 23 months in total), he can't make to here sooner as he have to pass the last exam.

What should he do, VIP member, Leon, all member please share your thoughts.....

If he has a longterm plan to come to Canada and stay for good, shouldn't he come to Canada sooner for training? I heard many foreign-trained doctors had to drive cabs before they could work as Canadian doctors.

I hread that too, but he's already made contact with doctors organization ... and has all the procedures, some exams has to be passed and his preparing for it, but the part of PR is the one I'm worried about and I'm asking for more advice.

One more thing, I guess it won't matter if you're short in your 2years residency obligation with 2 or 10 months, there's a possibility he can be reported?

Yes, I heard they will report you if you are short in the 730 days residency obligation.

He should enter Canada with his still valid PR card and hope that they do not report him on entry. If they do not report him on entry, he should stay in Canada for 2 years straight without applying for anything from immigration. After 2 years, he will meet the RO again and can apply to renew his PR card without a problem.

If he gets reported on entry, he can appeal for his PR.

Thanks guys, he'll be coming here February 2015 anyway with a valid PR (not expired), but it just less then 2years of RO (3months short by then).
Well Finishing up his education won't be a good excuse if he had to justify his absence? the question here doesn't make any better if he come to stay for short term a month or so in 2014, that way when they ask him when the last time you been in canada, the answer will be couple months ago vs 3 years ago ? I know the count still short.

Right, it's better if he was here because when they ask and he says he was gone for more than 3 yrs. they will know for sure that he doesn't meet the RO. However, they do have the option not to report him when he explains that he was completing his education. It's officially not a good excuse but they can let him in without reporting if they want to.

At this point I presume no other option is available like talking the CIC and explain the situation or having the documents as proof send over the the immigration before getting to canada? Just Take a risk and hope you won't be reported? Any other tips about how you can increase his chances to not get reported?

There is nothing he can clear with CIC beforehand because his PR card is still valid. To increase his chance of not getting reported, he should not lie or try to hide anything. He should simply explain that he was completing his specialty as a pediatrician and that put him a couple of months outside of the requirements but now he is back for good and planning to settle. Most likely, the immigration officers will let him enter without reporting.
