Hello Senior members,

I have an urgent query.
I landed in Canada in Aug 2011, got my PR card and SIN card at that time.
Later, I came back to India and now I am travelling again on 21-June-2013 for good.

Is there any restriction for mr travelling again to Canada?
Do I have to get any additional documentation from Canadian consulate to travel?
My understanding is that once we have the PR card, we can travel in and out of Canada without any issues.

Please let me know if my understanding is correct?
If my understanding is not correct, please guide me on how to proceed.

Sharat, you should post this question at the FSW or even CEC thread instead of under "Finding Work in Canada." While I am no senior by all mean, you must live within Canada for at least 2 years out of 5 years in order to maintain your PR status.

Keeping your permanent resident status

Your permanent resident status allows you to live in Canada, but there is also a time limit on how long you can live outside the country. To keep your status as a permanent resident, you must live in Canada for at least two years within a five-year period.

Assuming that you left Canada right after you landed in August 2011, you must live in Canada for at least two years between August 2011 and July 2016. So you don't need anything additional from the Canadian Consulate when you travel back to Canada as a Permanent Resident. Now, a word of caution: Have you been filing Canadian taxes reporting your Foreign Income? If not, beware that the CBSA will nail you at the border when you re-enter Canada. Have a safe travel back and good luck.

I did my landing procedures in 2010, then returned to settle in Canada in early 2012. Between those years I was residing in Japan with a work visa. When I came to Canada in 2012, nobody at the airport asked me anything about having paid Canadian taxes while abroad.

My understanding is that while a permanent resident of Canada is outside of Canada, he/she is seen as "non-resident for tax purposes"... unless the person has a considerable amount of assets in Canada (e.g. a house), in which case the CRA thinks that he/she has "ties to Canada".

Hi Shakira,

What questions did immigration asked you when you entered? Just want to prepare for my second landing and at this time to settle for good in Canada.

Hi,
I checked this with my CIIP mentor.
She also did not said anything abt thtis thing.
I do not have any canadian income and i am filing taxes in india.
So i assumethis wont be an issue.

Also, i checked various blogs and sites...nowhere i saw this issue mentioned...
So i am assuming that this might be one of situation and depend on case to case...
Please comment on this other members as well....

Hi,

I don't remember all questions but they were fairly simple and short, such as:
- From where are you coming?
- Why were you abroad since you landed? (I answered honestly "Because I had lots of responsibilities in my job and couldn't quit at the time I did the landing")
- With whom were you living before coming to Canada this time?
- Do you have a place to stay?

The officer just listened to my answers and did not say anything. At the end he re-validated my PR card and let me go.

I did both landings at Toronto Pearson Airport.

Hope this helps. You shouldn't worry too much. Most of the times they have to ask routine questions, and unless you have serious trouble answering or contradict yourself really badly, you should be Ok. At Pearson they also have interpreters for various languages.

Hi sharat_joshi77,

If you are living in a country that has a Tax Treaty with Canada, you don't need to pay taxes in both countries, or make any declaration to Canada. When you come to Canada to reside and submit your first income declaration, nobody will ask you to provide what you earned while in the country with a tax treaty.

Thanks Shakira. I thought you're from the Philippines by just looking at the Visa Office in your profile.

Great link that you have posted about the tax treaty. Im here in NZ and not to worry already if I have to file an income tax in Canada with my income here in NZ.
