Hello Guys,
I came to Canada in Sept 2015 and I was de-registered from university after one semester. I have masters and a bachelor's degree from my home country and foreign work experience.
CRS shows 441 as my scores for express entry. My dilemma is if I can apply for express entry with this background. Plz help me with this situation. Also my study permit says nothing in the "conditions" section.

Are you currently in Canada now, given that you lost your student visa in 2016 (I assume, based on what you told us)? If you are in Canada, under what status are you? Because that might be relevant to your campaign...

Determining Your Eligibility for Express Entry

The first thing you need to do is check your eligibility for Express Entry (EE). Unless you have 1-year of full-time Canadian work experience, you would most likely be trying to apply under the FSW programme.

If you are NOT eligible under any of these three programmes, you are unfortunately not eligible to apply for permanent residency through Express Entry (but there may be other ways for you to pursue permanent residency – these additional ways will not be covered here).

If you ARE eligible under one or more of these three programmes, please note that this does NOT guarantee you will receive an Invitation to Apply for permanent residency. Read on to learn more about your likelihood of receiving an invitation.

Determining Your Likelihood for being Invited to Apply for Permanent Residency (if you’re eligible for Express Entry)

If you're eligible for EE, you need to calculate your projected Comprehensive Ranking System (CRS) Score.

The CRS Score is what IRCC uses to determine which candidates will get an Invitation to Apply (ITA) for permanent residency. The general consensus is that, at least at the time of writing this, you need a CRS score of at least 435 to have a chance at getting an ITA; but please note that this could easily change in the future.

The easiest way to improve your CRS Score, if it is too low, is to improve your Language Test Scores. Applying for and securing a Provincial Nomination Certificate, or securing VALID arranged employment in Canada are other routes candidates take to increase CRS Scores, but these are difficult to accomplish, especially the latter.

Are you still in Canada? What have you been doing since de-registering from school in 2015?

Looks like you're still in Canada...

If so, you've been in Canada without status / illegally for over a year now. Your study permit was automatically canceled 90 days after you dropped out of school. Hopefully you haven't been working for all of this time (if so, you've been working illegally).

You can't apply to immigrate while in Canada without valid status - and it's far too late to restore your status. You have to leave the country if you want to apply for PR. Also, any work experience gained illegally while in Canada cannot be included in your PR application.

Thanks Scylla and Crescent_jam for your prompt response. What do you think should be my next step? Should I go back to my home country and draft a PR application, how many of such cases actually get a permanent residency? Or should I go back and wait for some time to apply for PR?

You can leave Canada and apply immediately. However, you will need to report where you have lived and what you were doing in the last 10 years. IRCC will very quickly find out that you were illegally in Canada and this will be a problem for you. Perhaps @scylla can provide more insights on this matter.

I was not aware of these conditions and was under the impression that CIC would notify me of any changes made to my study permit. I was mentally and physically ill in canada and was taking refuge at my aunt's place, who was not aware of any of such regulations as well. I think I have made a huge mistake in doing so. Can I just explain this in my application when I submit it from my home country? Any suggestions?

It was your responsibility to understand the conditions of your study permit and follow the rules.

Yes - you can apply for PR provided you are outside of the country. Make sure you are 100% honest about your history in your PR application.

Move back to your home country at the earliest and seek assistance from an Immigration Lawyer. Whether the CIC will consider your PR App or not is entirely their prerogative. It was your duty as a Student Visa Holder to know about the rules and regulations of a Country which had accepted you. No use is digging lost ground, just be honest in your PR application.
