No - you can't apply for an eTA. You are out of status in Canada. If you and/or your husband want to stay, you need to apply to restore your status. Your husband obviously also need to stop working immediately.

We can't make that decision for you. This is a decision you will have to make.

I'll be honest. I think you would be best off working with a lawyer since you seem quite confused about what to do and don't clearly understand your options. You can't afford any mistakes at this point.

I would hire a different lawyer to help you (not the same lawyer you worked with previously).

The only way to apply as a student is you leave Canada first then start over. The court will be too pricey and complicated, and I don't think you might get any second chance since you were Illegal here. As above mentioned, hire a different lawyer.
 
Sorry for your case but it seems that the lawyer is greedy.. How can she apply for the student while you are already a student? do you have to leave Canada for student visa ?
 
She is not a student, she lost that status 2 years ago.
since July 2020 Iam student on implied status paied 30K for college, and passed english levels but the IRCC was not infomred about this progress, I think the lawyer should have informed the ircc about the progress and payments i did

Your lawyer's mistake was to renew instead of applying for a new study permit since you lost status as a student in 2019, which rendered your permit invalid. I blame this on your lawyer.

Did you get such a document that you need to give to IRCC to show that you left Canada?
Because if they say you need to leave immediately how will they know you left Canada if you dont have this document?
