Need to Travel to US with family, but PR card renew is not back, help~~~

Dear Guru,

My PR card expired at the end of July this year, and I already applied renewal at the beginning of July this year before it expired. When I applied, it shows that takes no more than 150 days!!!! But now they change to 183 days!!! I also file the urgent application on Nov 26, and call CIC, they said it shows up as in progress still... For me, I stay 2 year and a month out of 5 years. And I hold a job in Canada now. So PR requirement is met.

At that time, I think it should be OK for me to book a trip with family to go for USA for Christmas holiday. We book trip fly to LV on Dec 25, then back on Jan 4, 2016 from Seattle by flight.

Is there any option? I hold a chinese passport. I really want to go with family. Is that possible that when I am back on Seattle, I rent a car in the airport then drive to the boarder to Vancouver? I have my expired PR card and landing paper. Would that be any risk? My family suggest me to not going and cancel the trip, but I really want to see if that's possible.

Hi

You can rent a car and drive across the border with your landing papers and expired PR card.

Thanks for your reply. My concern is that is there any risk to doing this? Because one of my friend submit the application early Dec with urgent and he already get approved and his PR card is mailing on the way. Compared to my appllication, he has stay here almost 4 year out of 5, and he submit all the tax information for all 5 years, such as NOA etc.

For me, I only submitted last year's tax information because I am in China in 2012-2013.

My concern is that would it because my stay time is not long? (But I do have met the requirement with more than 730 days in Canada), so that renew get delay? And if I leave Canada, it would be a risk?

No risk at all you can enjoy the Christmas in USA but you have to come back to Canada by your own or rented car commercial transport will not allow you to board without a valid PR.

As long as you still meet the RO when you return to Canada, there is no risk.

If you have met the requirements, then leaving Canada is not a risk. If you have not, then it is.

If you have already applied for a PR card renewal (which you have), let them know when you cross (by car), and they will likely not report you. If they did report you (because they suspected you were under 730 days), then you would be requested to demonstrate that you had 730 days, and upon doing so, you would be fine.

If it were me, I would drive back and bring the paperwork used to apply for a renewal.

You can enter Canada by car with Landing Document and License, we visited twice with same, but keep whole bunch of documents you sent to CIC for PR renewal, they may ask to see that papers, don't worry...enjoy

It's good that yo hv sent PR for Urgent Processing.....CIC is busy in processing PRs for Refugees....they are least concerned with the people living since long....nobody know how CIC staff is working, for 70%+ plus applications they are sending for secondary review and Govt has no interest in speeding up the process..

I think I also miss to send them all the passport pages, thats my mistake. I didn't get any Personal immigration entry/exit record or movement certificate issued by the countries where you have travelled, should I just explain to them???? What should I do else for that as I don't have any record of these?

So now, I am going to send all the passport pages to them today.

However, will I be lucky to have the new PR card before Dec 25? I am now concern about the risk to travel to USA, should I cancel my trip based on the current situation?

This refers to the application(s) for a Permanent Resident Card that you filed with this office. The purpose of this letter is to advise you that a preliminary review of your application has been completed and additional information is required before our final review can be completed. This will result in an additional delay. However, we will endeavor to finalize your application as soon as possible.

For the purposes of determining if you have upheld the residency obligations in meeting the requirements for a Permanent Resident Card and in accordance with Section 28 of the Immigration and Refugee Protection Act, please provide us with proof of your residency in Canada for the period NOVEMBER 19, 2010 to NOVEMBER 18, 2015. Please submit a copy of the following documents dated within the period specified above:

 - Complete pages (including blank pages) of your passport(s)/travel document(s) held in the last 5 years. Ensure all pages are in colour and are clearly legible.
 - Personal immigration entry/exit record or movement certificate issued by the countries where you have travelled.

If the documents you provide in support of your application are not in English or French, you must also provide a certified copy of English or French translation and a certified copy of the translator’s declaration. A translator’s declaration must include the translator’s name, the original language of the translated document and a statement signed by a translator that the translation is accurate.



If we do not receive the requested information within 180 days of the date above, we will consider your application for a permanent resident card abandoned.

Any new information submitted after the 180 days will require a new application, fee, photos and relevant documents.

You cannot just explain to them that you don't have the travel records. You need to GET THEM. If you don't, they will refuse your app.

This will have no effect on travelling to the US.
