Need to sponsor my spouse but have a situation...Please help.

I need to sponsor my wife, I got married in May 2011 in Pakistan, my Nikkah was done at that time, big ceremony, but no Rukhsati was done, as it was suggested by both, my wife's mother and my father, that after I finish my education, we will do the rukhsati part.

But unfortunately, I cannot go, because there has been death threats my dad's ex-wife and her son, both have said that if I ever come, they will have me killed.

Everyone here in the family is against this idea of me going overseas for this reason. But when I contacted an immigration consultant here in Toronto, Canada, he advised me that I must provide evidence that my wife and me are in a genuine relationship and are indeed husband and wife and for that I need to go there and take her out on a honeymoon trip and bring back, some pictures showing she and I together, in a park etc, plus hotel and restaurants receipts.

I was planning on doing all that, but now I cannot go, because of death threats.

I do talk to my wife everyday, many times, I do have pictures of Nikkah, as well as the Nikkah video movie plus telephone bills, showing my wife's contact number etc. That is all I have to work with.

My question is that would the immigration officer accept my evidence that I have or do I need to provide further evidence as this consultant has suggested?

Why can you both not go to a different country for honeymoon. It is about the pictures, etc not where. Not sure what your culture allows but look at all options that meet that culture and your safety.

How will she know you are back in the country? Can you discreetly go back, get security(like 2 or 3 big guys for your protection) then have a small ceremony with close family and friends?

Or you can meet in a different country and do it there.

No. Not everyone has a honeymoon. Where the form asks about your honeymoon just write your answer on a separate piece of paper and explain that you haven't had one, and why. This won't delay your application and is not enough to cause a rejection.

I would say you both should meet in a different country, let's say Dubai or Thailand. If you want to apply with out honeymoon pics u should then just apply and worse case scenario they will ask for an interview and then your wife will have to explain eveything at the interview. Attach letter explaining everything though or if in case you have any evidence of those threats show them that aswell

Hi! I'm very sorry about that issue with your dad's ex-wife. I think it would be best to play it safe, and not risk you or your loved ones getting hurt if they really carry out the threats. Wish you and your family peace and safety!

With regards to your honeymoon, if you really want to push through with it, the other members suggested meeting up at another place. Otherwise, if you don't go on a honeymoon, it's not like they are going to reject or delay your application. Me and my husband didn't have one, because we had to postpone our wedding ceremony. We still ended up going on our trips, and explained in our application the reason we didn't have a honeymoon.

It's important to remember that the CIC forms are generic forms and every relationship is different. Having a honeymoon for immigration purposes is, in my opinion, a silly idea. Having a honeymoon because you want to share a special time with your spouse should be the only reason for having one. Every marriage is different and CIC don't expect us all to be the same.

We didn't provide photos from a honeymoon and that was okay with CIC. We attached a page and explained why. Other people marry and plan to have a honeymoon later, when they can afford it. That's fine too. Some couples don't ever have a honeymoon and in some cultures a honeymoon is a foreign concept. CIC does not deny applications because of that one thing.

A honeymoon can add to relationship evidence but if you have plenty of other evidence (photos of the two of you together, photos of the two of you with other family members and/or friends, telephone records, emails, etc) then just look to see if that is enough. Unfortunately, you can't send videos (but maybe you could get some photos extracted from the Nikkah video). Add an explanation on a separate sheet of paper about why there isn't more evidence. You have been married for over two years so it shouldnt be an issue.

From what I've read, it is more difficult to get approval without having done the Rukhsati. Have a look at this recent thread, PMM explains it well and provides quotes from CIC regarding the refusal of nikkah only couples.

I spoke to Immigration Canada here in Ontario, Immigration Canada spoke person(lady) advised me that you do not have to have actual Rukhsati, but you do have to provide us prove that you and your spouse are indeed married and communicate on a daily basis, the proof includes, telelphone bills showing your spouse contact number, chat logs, text logs, skype conversation, receipts showing money sent etc, as well as pictures of Nikkaha ceremoney, Mehndi ceremony.

The only time they will question you is when you are, say 24yrs old, and your spouse is twice your age, in worst case scenario, they will call you for an interview.
In my case, she said, I do not need to return for Rukhsati ceremony, as long as I can provide them with all of the above as a proof of a genuine marriage.

Yeah right. I suggest you go to http://www.canlii.org/en/ca/irb/index.html and search on text Rukhsati and read the refusals where there was a Nikha Nama, but no Rukhsati

I have to agree with PMM. There are a lot of refusals when only the nikah was performed. Sometimes the explanation given is that the couple is not really married until the ruksati, so why was it not done? Some people are accepted with just the nikah, but I would guess that at least it will cause delays. CIC gets a lot of fraudulent applications from Pakistan, so they are quite picky about the evidence needed.
Do you have daily phone evidence? And not just with calling cards. And all the other proof of contact mentioned?

It seems that if you say that the Rukhsati will only be performed once a PR visa is issued, it is the "kiss of death" to the application. It makes it very clear that the marriage is for the purpose of obtaining status in Canada.
