Hello,

I am a PR holder, living outside Canada (Oman). I recently got married outside canada (in Pakistan). I am aware that i cannot sponsor my wife unless i am living in canada. I need few clarification in this regard:

1: Do i need to inform Canadian authorities about my change in circumstances (marital status) while i am residing outside Canada? if yes, what are the timelines (deadline to inform them) please let me know the procedures and related links. and do they need any document (for evidence) at this initial stage or just an email would be sufficient that my circumstances has been changed since the day i got married.

2: What are the pathways/possibilities that Myself and my wife would be able to move to canada altogther. I heard that there is a possibility that first i can apply for visit visa for my spouse (as there is not requirement for me to be in canada) then i can go for spouse sponsored visa once me and my spouse would be in canada.

3: My spouse has also got valid 2 years US visa (Masters scholarship visa, student visa), bases on that US visa i believe she can travel to Canada (after getting ETA before travel from canadian authorities) so in this case do i still need to apply for her visit visa to Canada? pluse let me know the procedure for getting ETA from canadian authorities.

I would really appreciate well thought replies. Thanks in Advance.

Regards,

1. No, you don't need to inform Canadian authorities.
2. Options are: TRV, work permit (requires her to secure a job offer in Canada and for her employer to get an approved LMIA), and study permit (requires her to be willing to take a full time university or college program in Canada and show she has enough funds for the international student fees + living expenses).
3. She only qualifies for an eTA if she has a US green card. If she only holds a temporary US visa, then she needs a TRV to travel to Canada.

We are open to this so far, because if we see the viable possibility of moving together to Canada then she can leave the masters program from US.

Would love hear more about the application procedure of TRV for spouse. as i have explained my thread since im still residing outside canada therefore i cannot apply for spouse sponsorship. At the moment we are seeking possibilities of moving together which seems possible with TRV for spouse.

Unless she had made it through enough of the program and had enough ties (like a longterm lease) that it would make sense that she was only visiting Canada, then studying in the US could maybe make it easier to obtain a TRV. Realistically you need to prepare yourselves that you could be separated for all or some of the sponsorship process.

Nope she hasnt started her program yet neither she traveled yet, it is starting Jan-2022 but she has got her visa. By saying that i could be separated for all or some sponsorship process, you mean i wont be able to apply for her PR via spouse sponsorship at later stage?

See, what I am looking is a possibility without US thing which means that at the moment shes in Pakistan and i am looking for options so that we can move together to Canada.

so in this case can we go for TRV by explaining the reasons that we want to move together once we will land there then we will apply for spouse sponsorship? will this idea may cause difficulties in getting sponsorship at later stage?

I look forward to hear from you soon on this without materializing US option/travel.

Thanks in advance.

There is a good possibility that you may be in Canada during the sponsorship process and she’ll need to remain in Pakistan. If she wants to attend school that is an option but you can’t count on her being able to get a TRV from the US either. If you say that you both want to move to Canada to do inland sponsorship on a TRV application you will be denied. Most couples aren’t able to reunite until after their spouse has been approved and can come to Canada.

alright, it means that TRV isnt the viable option and i have to start with spouse sponsorship directly once i will be moved in Canada.

what if she will go for her masters in US. and during that time i will move to Canada. so would i be able to start Spouse sponsorship application directly (without looking for TRV options) while she be studying in US as its a 2 years program??
I hope in that case i wont be denied from Canadian authorities.

Yes, that will work.

However you can also try for the TRV. There is no harm in applying. Approval is certainly far from guaranteed but you might get lucky and be approved. Suggest you read through the other posts in this section of the forum to understand common refusal reasons and how to put together a strong application. Good luck.
