Hi,
I want to take suggestion/advice from this forum about planning on new baby after spouse sponsorship is applied. Below is the scenario,
My husband has a PR and currently residing in Canada. I’m working in India and planning visit my husband for a month using tourist visa and we are planning to apply for the dependent spouse sponsorship while I’m there. I would like to know if it is advisable to
1. Plan for a baby after my dependent spouse sponsorship process is completed? (which would be approximately 13 months from now)
(OR)
2. Plan for a baby while the dependent spouse sponsorship is under process? In case I become pregnant while dependent spouse sponsorship is under process, then
a. What would be the next steps and
b. Approximately how long (how many months) would it take get the PR for the spouse and the new born baby?
Kindly request to share your suggestion/ideas based on your experience.
Thanks in advance for the help.

If you give birth to the baby during the process, the baby will then need to be added to the forms as a dependent, so you will have to resubmit the forms to the visa office.

If you are granted PR before you give birth to the baby and land in Canada, you may have to pay for the birth if you are in a province where there is a 3 month waiting period before receiving the provincial health care. Some provinces have instant health care upon landing. Ontario doesn't.

If you are granted PR, land, and then return to India to give birth, then the baby will be an Indian citizen and you will en have to apply to sponsor the baby.

Thanks for the response.

I think it takes 13 months approximately to get the spouse dependent spouse sponsorship, in case I become pregnant while the PR is under process how many months additional it would take apart from 13 months to get the PR for the child? Please advise.

I don't know, sorry. Ask in the New Dehli thread. Personally, I think you should wait until you are a PR to get pregnant, or at least much further into the process, that way you will have provincial health care, your baby can be born free of charge in a Canadian hospital, and your baby will be Canadian. That is if you're not already pregnant....

I think an important question/angle has been missed. Once you are here in Canada on visit visa and apply, will you be applying "inland" so that you can remain in Canada for the duration of processing on implied status? If yes, then the baby born in Canada would be a Canadian citizen and would have no impact on your spousal application for PR.

Becoming a permanent resident in Canada is a lot of stress....
the process and waiting is long....
you don't need to give to your baby all those feelings of insecurity...

Its better if you wait to be in Canada and have all the rights of a Permanent Resident,
Including Health Care,
To take the decision of having your baby...
One visit to emergency in Canada without Health Care Insurance may amount for over 1,000 a day...
you don't want to have the stress of paying all those bills from your pocket...

besides...
if you have your baby in India,
then the baby will need to wait to have the visa ready,
that would mean that you will have to leave the baby behind
to become permanent resident before your visa expires...

or wait additional time to have your baby included....

to be honest,
All the problems that can arise from a bad decision are unpredictable...

So, in conclusion...
Have your baby when you are resident and live with your husband

Thanks for the quick responses and suggestions. This is helpful. I will be applying as outland as presently um working in India and visiting my husband on tourist for a month.

I understand that PR process is complicated, however if it takes just couple of months apart from 13 months to get the PR for the baby then may be it is still ok, however if it takes more than 6 months or so then it would matter. So if anyone has applied PR for baby while the spouse PR was under process, please let me know the approximate processing time taken to get the PR for the baby.

It won't be 6 months.

If your PR app is close to approval when the baby is born, then it will be delayed for however long it takes you to obtain the baby's documents (birth certificate, passport), have the baby's medical done (just a simple physical, no tests) and submit everything to add him/her to your app. Once CIC receives the documents, it won't take long to complete your app, as there are no background/security/criminal checks to be done on an infant.

If you are still a few months away from PR approval when the baby is born, adding him/her to your app most likely won't have much of an effect, if any, on the processing time.
