HELLO EVERYONE!!!

I recently pass my CEC application but the immigration send back my papers and now confused me. I declare my status under legally separated as per their application guidelines question 13 that legally separated is married but no longer living with spouse and I attached an affidavit of separation signed by me and my husband. what confused me is if they didn't acknowledge my affidavit or they didn't acknowledge my legally separated declaration because they noted that I am legally married and not divorce and need to submit my husband's background declaration and additional family information. But now I want to try to pass my application again still under legally separated and made new affidavit. Do i still need to put my husband's information in all my application like my dependant? and do I still need to produce his background declaration and additional family information?

Really don't unstand what ur saying.. do u mean to say that ur application was returned because immigration believed that ur married and not separated?? and that u should include ur marriage certificate?? if i am right, u can choose legally separated but have to include ur marriage certificate because the checklist says to include all marriages certificates, death, annulment and divorce. And by the way, where was it mentioned in the checklist to provide affidavit of separation??? I was in same situation but included only my marriage license from that marriage and a written explanation of why i couldn't provide marriage certificate. i never include any affidavit of separation. Now my credit card is charged and i am waiting for AOR.

In any case, u have to attach written explanation (mention that ur separated and no longer with ur husband). There is part of the generic form where it was asked whether you have been previously been married or in common law, just choose yes and write ur husband name, the date when u married and the date when the marriage ended.
yes, u need to fill the background form. mention ur husband name but dont forget to include that ur separated. in my case, i mentioned his name and put in bracket "ex-spouse". u need to write ur additional family information (ur siblings) and not ur husband siblings.

ujbaby thank you for your reply. even me, i cannot understand their reply. they said that im legally married and not DIVORCE which i didnt say that im divorce. in their reply to me they highlighted which more documents i need to provide and they didnt highlighted my marriage certificate just the birth certificate of me and my husband. the affidavit of separation is not really in the checklist i just attached it in my application to support my legally separated declaration as that what i heard to other applicants here in our town. and ive read it in one of your post, youre asking about legally separated in CEC.

how is your application by the way? im sorry but i dont know whats AOR means. so, did you file married or legally separated? what marital status should i put in my application then? once i called to immigration and asked them my situation. i asked them what should i put in my marital status since me and my husband is separated already but not yet legally and im no longer want to accompany my husband in my application. the person told me that i can file as legally separated but i need to execute a supporting documents for that. i asked them what kind but she said she didnt know too for sure as it depends to the immigration officer who will examine my appplication. did you submit the addditional dependant form too? and how about the additional family information of my husband?

i didn't submit any information from my ex spouse other than the marriage license because he left with our marriage certificate and i left with marriage license. i only submitted what i had on hand and provided a written explanation. i didn't provide any supporting document for being legally separated because it is not in the documents checklist. yea, i inquired about legally separtion supporting documents in these forum and was advised to provide some kind of affidavit but i later changed my mind since there was no mentioned of such documents from the checklist. i only went by the checklist. u have to provide a written explanation and tell them that he's not accompanying u to canada and attach ur marriage certificate, u might also incllude the affidavit if u like. i submitted the additional dependant form too but the information i put down was for my children and my siblings. i only mentioned my ex spouse name and wrote unknown under his address section, then separated under marital status and nothing else. AOR means acknowledgment of receipt and u only get it after ur payment have been cleared. All the best to us.

you are separated officially, but you are not single.
and still responsible for your ex. until you get divorced, you are not single.
i would say why dont you apply for PR after you officially get divorced?

and why would she wait till she get divorced? don't u think that she might be running out of time and her status might be expired by the time of her finalized divorce??., i am also in her shoes and my cc have been charged. so i dont think it will be a problem for her to be legally separated.. she need to include her marriage certificate and provide some written explanation stating that she is no longer living with her spouse and that he's not accompanying her to canada.

what i am saying is you have 2 options.
1. you apply right now including your ex which means you have to include ex.
2. if you wait until you officially get divorced, you dont need to include your ex.
i thought its painfull if you ask your ex to file background infor. generic. etc in middle of divorce.
if your ex is willing to file all the documents, thats great.
if i misunderstand your situation, i apologize. anyway, hope things going well.

Her ex(legally seperated) don't have to fill any part of the form because he is not accompanying her to canada. gosh!!!!.. this lady is legally separated for crying out loud and ur here talking about her including her separated spouse and getting same spouse fill some kind of form. i don't get this and u have to unstand that she don't have to ask her ex( separated) to fill out any form. pls stop confusing us and if u don't know what to say, we better wait for seniors to suggest..

actually i am in the same situation too.. I have already filed for the divorce but haven't got it yet and i dont want to wait for this. I am legally separated right now.
do i need to include marriage certificate?
do i need to include him in the ADDITIONAL FAMILY INFORMATION form IMM5406 ?
or any other things i need to mention about him?

i hate this part... :(

do exactly what was said before. u can include him on additional family information but write separated under marital status, yeah include ur marriage certificate and any other supporting documents to prove that ur waiting for ur divorce to be finalized..all the best

Hi there, each application is unique and there may be more involved depending on the circumstances but generally, every applicant goes through the following:
1. complete the forms properly, mail to CIO in Sydney, Nova Scotia. They check that all documents in checklist are included, if so, package is forwarded to the visa office(e.g. CPP-Ottawa) chosen to process the application.
2. At the visa office, an officer begins processing application - checking for eligibility and background, criminal, security checks begin, etc.
3. If you meet eligibility, etc officer sends AOR(acknowledgement of receipt) and medical request or just AOR and medical request later
4. Once medicals are received and if you pass and all is well, they send a passport request
5. Passport sent back with PR visa and COPR(confirmation of permanent residence) document and instructions for landing either inland or at a border
