Need Serious Advice Please..

Hello,

I am a Canadian citizen, looking for some advice for my girlfriend who is a us citizen. She came to visit by Train and didn't need a passport in order to get into Canada. We have been living together since then. After about a year, we were told by a relative of mine that we could be in serious trouble and both do jail time if we get caught. Also that a passport is now needed in order to travel between US and Canada. Then we found out her state picture ID had expired. So we both became quite freaked out and scared. Neither one of us has ever been in any serious trouble or even been to jail.. and this was her first time ever leaving the US. I myself have never left Canada.

We are very happy together, but we both know that she has to go back. We are still scared, but we want to get married and have a life together. Definitely can't do that living scared and her being here illegally. We had no idea that there was a legal time limit that she could be in the Canada. She wasn't informed when entering using her birth cert and state ID. Only thing she has from entering is detached instructions of a form she filled out on the train before entering. She said they verbally asked the purpose for the visit and she told them she was visiting her boyfriend, and that was it. She did say that the form asked her how long she planned on staying, and she put 2 weeks. We didn't plan on her staying longer than that but things were so awesome between us and still are.

So its no ones fault really but our own, and our complete ignorance of immigration laws. We no longer want to fear what's going to happen. Just want to get it over with.. and get her back to the states as soon as possible. So what would be our best course of action to get her back to the states without a passport and expired state ID, birth certificate & social security card? Also will we have to go to jail?

Her family has told her to just come back.. they won't keep her from entering. But I think she's super terrified.. and just wants to know ahead of time what will happen. Also she doesn't want anything to happen to me. Any help or advice would be greatly appreciated. Thanks in advance.

Id suggest contact an immigration lawyer and ask them. Alot of lawyers offer free consultancy/advice...

Google them up....

She will need to get a passport. There are U.S. consular offices in various locations. If she came in on the train, that means she was near Toronto, Montreal, or Vancouver. All three of those consulates issue passports, as far as I know.

Relax my dear, we are here to provide you best of our advice to get you and your girlfriend out of this mess. After reading your mail, it seems you both really love each other and want to get married, is it true ? When her's US State ID expired ? She never has a passport ? She has to renew her ID at least to get back to US. She can go to any nearest Consulate to find out, how one can renew ID from Canada there is nothing to afraid of. Has she ever worked in US ? Don't worry, everything will be fine. :D
