Hello everyone,

My husband is applying for his PR under the Express entry regime. I already have a canadian PR and we are both currently in India. My real brother is a Canadian PR. Both of us plan to move together once my husband's PR gets through. In such scenario can my spouse claim the points for my brother being blood relative resident in Canada and holding a PR??

Hoping for a prompt reply on the same..thank you in advance..

I don't think so. We can only claim point for immediate blood relatives like Siblings or Parents as PR's

Hi ganesh,

He is my blood relative, the crs reads the question as follows
Do you or your spouse or common law partner (if they will come with you to canada) have atleast one brother or sister living in canada

The answer is no - your husband cannot claim points for your brother.

Your husband would only be able to claim points for your brother if you were not yet a PR and you were included as an accompanying dependent on his application. Since you are already a PR, your husband cannot get points for your brother.

I guess that is the case when spouse is included in the application as a dependent.
