Need Info about Employee Reference Letter

My employer is a Indian Multinational and have office in US, Canada and Many other countries. I am eligible for CEC and my employer has agreed to issue the letter. My question is whether the letter needs to be issued by the HR in canada or will the letter from India HR will also work.

Senior member's help is much appreciated.

Reference letter must be from Canada HR (In letter head Canadian Address must be there).

Thank you for the quick reply.

I have just returned back from Canada to India and My employer says that since you are employee in India, The Indian HR will issue the letter. And i will be applying from India under CEC.

Will the CIC Canada reject my application if the letter has the office address of india.

Below is the format of the reference letter, need advise whether anything needs to be modified in it,

This is to confirm that Mr XXX is an employee of ABC in Mumbai, India. Mr XXX and has been employed with ABC Corp in India since XX/XX/XXXX and was on assignment to ABC Corp in Canada from 4th September 2012 to 30th Dec 2012 and from 1st June 2013 to April 30th 2014. He currently holds the position of Technical Lead and was entitled to work for 40 hours per week.
His current duties include
Maintain existing Sharepoint platform by making modifications and configurations as required.
Identify and communicate technical problems, processes and solutions to the users and Management for quick resolution of service incidents.
Assist in the collection and documentation as per requirements by the technical team and by the users.
Deploy, test and validate solution packages for Internet and extranet Sharepoint web applications in QA, Pre-Prod and Production environments.
Co-ordinate and collaborate with other teams like SQL, network, Sharepoint developers and programmers, and third party ISV vendors.
Building, Designing, Architecting and Migration of SharePoint servers. Install, maintain, troubleshoot and upgrade Sharepoint Infrastructure. Ensure high availability of Sharepoint farms. Research and resolve high visibility incidents by following ITIL processes.
ABC Corp Canada was paying him an annual salary of CAD XX,XXX.

The best option is a letter issued by the 'Canada HR' team or your Canada Manager. In case they are unable to provide it for some reason, then you need to make sure that you are communicating this very clearly to the Visa Officer and that the letter issued by the India HR provides ALL the information that is requested by CIC so that you are able to prove the authenticity of your reference letter and leave no doubt.

It would help that the India HR letter also includes the following information.

- explanation as to why the Canada HR team cannot issue the reference letter.
- that you were employed 'full time' with ABC Corp Canada (even though your current letter states 40 hr/week)
- the Canada address of the organization.
- email and telephone no. of the Canada office or Canada HR and/or your Canada Manager.

In your case, an India office is providing the information that is requested from a Canada office which is unusual and may make things tricky, and hence you need to be sure that you are able to convince the VO a 100% that you worked full time with the Canadian company.

I would again stress that the best option is to procure a letter from the Canada HR/Canada Manager and I am sure there must be some way to procure it. There may be colleagues who have applied under the same category and faced the same. You may talk to them (forgive me for mentioning such a basic thing, but just in case..)

If your Indian HR is issuing the letter they should speak in past tense and not present as CIC is interested in knowing your responsibilities and position when you were in Canada and not in India.

Fully agree with ABS_1382... Your letter should explain your salary, job title and job duties of the periods you worked in Canada... If it's on a letterhead with Indian address, then include your company's canada address and communication details in the content of letter including client location (if any)

I got it, But if my employer issues the letter from the Canada HR, then it should be ok with "His current Duties Include" right?

If you are still in Canada then present, if not then past.

moksha80 buddy, just think logically...If you are writing something for the past it should be in past....If you get the letter while you are in same role it can be present as you are still perform those duties, but if you have changed role or come back to India it has to be past as your position or location has changed....My suggestion would be:

The Canadian HR as agreed to give me the letter on the letter head of my organization's Canadian office address, phone and email. However, the HR says that they will only respond to CIC for employees who are in Canada. I am not sure what does that mean, the HR says that they are assuming that ill be declaring that i am filing for PR from india. And for reference they will ask CIC to verify from Indian HR.

I have sent an email to the Canadian HR asking whether they can atleast confirm that i was in canada which i was legally working and then say that i have returned back to india.

Do you guys think i should ask for any more clarifications. I am thinking of sending this email communication along with the application, so that VO knows the details.

My take on this is that your HR is being extra caustious or rather OVER cautious...I do not understand what difference it will make if they call the Indian HR or the Canada HR. Its one company and the VO just would like to confirm that this guy has worked in Canada for the declared period....Regarding declaration that you are applying from India...I believe you can assure them that you are applying from India as you would be selecting 'New Delhi' as the visa office....

I am not sure if you should send this email communication with your aplication....I will leave it for seniors to decide as it will create confusion in the mind of the VO....but this is just my thought....

This is the key thing and the very least they have to do for you, if CIC wants to verify your past employment under their administration. CIC may ask to verify your duties and salary also.

Dear Moksha,

I was also in same condition as yours but for me neither Canada nor India HR was ready to issue me a letter as they considered it against company policies. SO I took a rejection mail from HR that they can't issue me a letter for Canada PR. I send the mail with my application and took reference letter from two of my supervisors stating the details. For me that worked and I was issued a PR. But I totaly agree that if you get letter from Canada HR and they are ready to verify your details then noting better than that.

I am not sure "Technical Lead" comes under any qualifying NOCs. Seniors may pur more light on that.

Hi Abhi,

My NOC is in A category as my work permit has Interactive Media Developers. So ill be applying in the same category as before. Its just my designation is Technical Lead, but my duties match with the job code. :)

But i guess to sum up from the above discussion, its necessary that my Canadian HR has to atleast confirm that i am employee of the company and that i worked there legally for the time mentioned in the reference letter.
