Need help Renewing my pr card

I am a u.s citizen and holding a Canadian pr card. I landed in November 08 and I don't even know how long I have been stayed in Canada, because I travel back and forth between u.s and Canada 4 times a yr because of my parents every time i came back to canada I stayed for two or three wks since I landed. I am still visiting my parents in the the state right now and my pr card will be expired in November 13. My question is what is my chances are keeping my canadian residency statue? For the last two yrs I have been walking across the broader without any problems.

With a US passport, you can probably continue crossing the border without a problem but your problem is how are you planning on renewing your PR card. When you apply to renew, they will ask you how many days you have spent in Canada since you landed as a PR or the previous 5 years if your landing was more than 5 years ago. If you do not know when you were in Canada and make up some dates to put on the application, they will compare that with their own data from CBSA and the US border. If they come up with different dates than you do, they will call you in for an interview and ask you to prove that you spent at least 730 days in Canada as well as ask you how come your dates don't match with theirs. If you fail to prove that you have 730 days in Canada, they will not renew your PR card.

I still got some questions to ask u. my kids they were born and raised in Canada and i have to be there for them. The questions are:What if I move to Canada before my pr card expired and crossing the border without getting caught. Can I still stay in Canada for two yrs without leaving the Country and then renew my card? It will be expired in the middle of November. Since I am walking thur the border from Niagara Falls with my u.s passport and pr card,what are the chances getting caught for not meeting the requirement? If i tell them i really want to stay and live in canada,will they report me? If I lost my permanent residency card can I reapply again with the kids' mom sponsor me? If my pr card expired, will I be able to renew my health card while staying in Canada? I am so worrying that I won't be able to stay with the kids in Canada.

If you do get back to Canada one last time without getting caught for not meeting the residency requirements, then you can stay for two years straight and after that apply to renew your PR card. You are not supposed to need a PR card to go about your business in Canada but government asks for it sometimes anyway. You will have to try to find ways around that if it happens. Show your expired card and see if they notice that it's expired. If they do, say that you have applied to renew it but your application is taking forever. It could be true. Because of privacy issues, health care can not check that with immigration.

Ok since I can't meet the permanent residency obligations. And i don't know if I am gonna get caught when entering Canada if i did can I turn in my pr card at the border and sign myself out of the permanent residency statue and then start over again and try to reapply again?

If you get caught on entry for not meeting the requirements, you can offer to renounce your PR and they let you in with a visit visa or you can let them report you and you either appeal for your PR which you will lose unless you had good reasons or you don't appeal which means you will most likely lose your PR. Then you can apply again if there is some immigration class you qualify under. Your kids mom can sponsor you if you are married or if you have been living together as common law for 12 months or longer which doesn't seem to be the case if you are only coming to Canada to visit. You know, if you just want to visit for a couple of weeks each time, you don't really need a PR.

If they catch you but for some reason don't report you, then you will have the option of staying for 2 years straight and thereby putting your PR status back in good standing.
