Hi
I am filling this form for spousal outland application and have a questions if anyone can help me

My spouse is holding a british passport so he doesn't need a visitor visa to come to Canada. For the question, Current country of residence - what should we put ? England or Canada. He is planning to stay in Canada with me for a few months until we hear back something. Will that be a problem if we put Canada as country of residence?

will they question why he is in Canada or will it affect my application in anyway if we mention this t the immigration

I am not an expert by any stretch of the imagination but I encourage you to check this further. To me residence would be where he lives not where he is visiting. Would it not change your application to an inland as opposed to an outland? Those are questions I would want to know first.

This is what I was thinking but inland application is mainly for someone who is either a student/worker or refugee I think
Also, his legal entry is as a visitor so not sure what will be the impact
Do you recommend keeping England as the contact address

My impression is that anyone who resides in Canada and is applying even on a visitor visa becomes an inland application. Outland is faster. Because I am wanting this to move quicker I would try to keep his permanent residence as England. Again please check with others.

No. An inland application has different forms. You can apply outland even if you are in Canada.

Put the country of residence wherever the applicant is residing. It doesn't matter where they are.

This is incorrect, he can have his residence in Canada while applying outland. CIC doesn't care where his residential address is, it won't affect his application. Look up "dual intent". CBSA cares where his residence is, so for visitor purposes, he is "visiting". For CIC purposes, he can be living in Canada.

Whether you apply inland or outland depends on which forms you choose, not where you live.

Thank you everyone for the response. I am thinking not to lie about anything. So I am going to put his current country of residence as Canada. In the contact information, I am going to put his mailing address in Canada and residential address in England. If they have any questions. atleast we are not hiding anything and he is a visitor here so he can stay for 6 months

I am not too sure if I am doing the right thing

I can do that but what I am supposed to write for the dates in the current country of residence section
he can only live here for 6 months on a visitor permit

Put the date that his current stay expires.
