Need help please advice TRV denied

Hello everyone,

My mother (principal TRV) and I (secondary, 47 y/o,single) applied online, She was granted but i got rejected. My mother needs a companion everytime she travels. I got rejected because of not solid proof of my home connection. I resigned from work, years ago for reason that my mother needs somebody to housekeep/caregiver.

Please advice me what to do and also on the part of my brother and his wife ( who recently passed canada citizenship exam.) The only reason I applied for a TRV is to escort my mother because the air travel direct is about 18 hrs. I especially does not intend to stay in Canada because I cannot tolerate the cold climate and much more my mother, so the maximum time we can stay in Canada is during the summer. Another thing is I can't stay away from home too long because of the farm lots which I started to venture into organic farming.

I really need help since the air tickets bought by my brother is dated May 10. Your help is very much appreciated.

Your only option is to apply again and provide stronger evidence of ties to your home country to prove that you have no plans on remaining in Canada long term. You should provide evidence of anything that proves home ties: property you own, your organic farming venture (if you can show proof of income from your business), etc.

The organic farm has no income yet since I have just started early part this year, I have only 1 farm lot in my name and the other land property and the small house given to me by my late grandfather are not yet in my name. I have only a minimal amount in the bank. The only document I submitted so far in my application with my mother is my passport and birth certificate.

How about on the part of my brother and his wife? what can they do to prove that they will be sending me back home after the specified visit in the letter of invitation?

There is nothing your brother and his wife can provide to prove that you will return home. This is evidence you have to provide since it's your ties to your home country that have to be shown.

Scylla has answered your queries.... apart from the regular documents that your brother will provide as host, there's nothing else that he can submit to prove that you will return home.

Based on what you've mentioned, it is difficult to get a TRV if you only submit your passport and birth certificate.


A couple of suggestions that I can think of:
a. Would it be possible to quickly transfer the land and house that you inherited from your grandfather? This will help to establish property ties for you..... and can you do a self-evaluation of these properties.... and mention the value of these properties in your TRV application?

If it is not possible to transfer these properties on your name quickly then you must submit clear documents (translated into English, if required, and notarized) that prove you have inherited these properties indisputably.... no other heirs.... and you have initiated legal steps to transfer it to your name.

b. Do you have a ready-to-implement plan for your organic farm lot? Can you provide an explanation with supporting evidence for this, including evidence that it has been allotted to you?

c. Have you accompanied your mother abroad in the last 10 years (any country)? If yes, you can provide entry/exit stamps + visa details in an explanation to prove that you have returned home after each visit

d. Have you traveled abroad (without your mom)? If yes, then you can submit an Explanation: My Travel History

e. Do you have any financial investments in your name? For eg: you must prove you have the financial means to support yourself for the Canada visit

f. Do you have other family immediate/extended in your home/home town?

g. As for the tickets that your brother has purchased, are they confirmed tickets? You can then stress on the fact that you must return by XX date to begin your organic farming venture

Thank you for your suggestions.

a. It would be difficult to do it because time frame to do it is very short

b. The farm lot is under my mother's name and just started working on it January 2015, there are now livestock i have put and also started to plant foriage for the native chickens and native pigs and a number of pecking ducks.

c. It is my mother's first travel outside our home country.

d.Yes i have traveled twice for tourism in Indonesia and Malaysia. I have submitted my old passport with stamp to support my travel history in my previous application.

e. I have a passbook with about 5,000 Cad Dollar if converted

f. Yes a nephew is under my care, and his father, who is my sibling, lives in our country. Yes I have extended families in our hometown, in fact, It is me whom they ask for help, like accompanying them for medical reasons. especially my aunts who are senior citizens and are single and living alone.

g. Yes they are confirmed tickets for six months but in the event that the weather gets cold, we would go home the soonest possible for my mom's benefit and also for me because I myself can't tolerate cold temperature.

Thank you again for your suggestions, I will try to submit an application again. I have not mentioned anything yet to my mother since she will get depressed, because she missed my brother so much and also my nieces. My mother is attached especially to the eldest because they have close relationship when they were still here in our country.

My suggestion is to provide Explanations along with evidence:
a. The properties you have inherited.... with evidence


b. Your Organic Farm: who will manage the farm lot in your absence, why you cannot leave the farm to someone else for more than a few weeks, if your mom has given you written permission to manage the farm on her behalf, etc


c. Explanation: My Travel History.... listing entry/exit stamps + visas for Indonesia and Malaysia.... although these countries are generous in issuing tourist visas.... the visa officer may/may not go through your old passport


d. Bank statement for last 3 or 6 months (as per the checklist for your country).... no large deposits recently otherwise you must provide an explanation for the source of the money


e. Explanation: My Family Ties..... list your immediate family/addresses + very briefly about your extended family

You must mention your nephew is in your care.... you can mention (if it is the case) that you are visiting Canada when he has school vacations, and you must return when his school reopens..... also add proofs for his school admission + proofs to show he is living with you at the same address + your aunts who depend on you (do submit any proofs to substantiate this)


f. You can add an explanation that your brother has purchased your tickets + he will take care of your accommodation/living expenses in Canada.... by doing this, the approx. CAD 5000 bank balance will appear stronger to finance your visit.... as you do not have to spend any of it to buy tickets


You can mention your visit is for 3-4 weeks because a longer duration visit will give the impression that you do not have strong ties to your home country.

Also do give an approx. day-by-day itinerary for sightseeing/meeting friends and relatives.... and your Purpose of Visit is not just to accompany your mother as a caregiver


A visa refusal may be difficult for elderly parents to accept.... don't worry.... hope for the best

I just noticed that you have booked your tickets for 6 months.... this is probably the reason for refusal because despite any evidence (to show your ties to the home country), your intended visit of 6 months vis-a-vis your tickets proves the contrary..... and it shows you do not have strong ties to your home country.... it's a different case if your mom wants to visit for 6 months

Dear Bryanna,

As i am preparing things for my re-application, could I still use the Booking Itenerary with confirmed ticket length of stay is more than 5 months but less than 6 months? My brother purchased it last March and surprised my mother that he would be inviting us summer 2015 and at the same time attend her daughter's graduation.Or does he need to have the tickets rebooked? For how long?

Also, if I am applying online, where can I attach a cover letter? Can my mother also write a letter to the Visa officer?

Hi,

In my opinion, a confirmed ticket for a visit of 5+ months would indicate that you do not have strong ties to your home country.... and regardless of the ties/evidence that you provide, these 5+ months plane tickets will prove to be counterproductive.

On the other hand, it may become an expensive exercise to cancel your existing tickets and re-book for a shorter trip.... as you are traveling in May so tickets may be expensive at this point.

If your ticket fare conditions allow change of dates.... by paying the date change fees and fare difference.... then this is something you can consider.... then again, how will your mom manage for the return flight back home?


Ideally, you should mention a visit of 2-3 weeks.


I don't think a letter from your mother to the visa officer will help.... nevertheless, what would your mom write?

Any reasons for an online application this time?


My advice is to provide strong ties with detailed evidence based on the suggestions mentioned in this thread

try to apply again. worst case scenario your mother can travel to canada using a wheelchair service of the airlines. My mother who is 71 will be going home alone and I requested a wheelchair from Canada to her stopover to Manila. She wont do anything. wheelchair to and in the gate.

You're right about the worst case scenario where the OP's mom could use the wheelchair service.... besides someone using a wheelchair gets to board the plane first.... no long walks to departure gates.... and airline staff do take care of wheelchair persons.

Perhaps, the visa officer believed that the OP's mom was capable of traveling on her own.... and hence, she was issued a TRV.

The OP submitted only her passport and birth certificate.... no other documents.... this did not help her case.... so if she applies again with evidence/ties to the home country then she has a good chance

Thank you very much, I will do as you suggested as I pray for God's favor and be able to convince the Visa officer that I really don't have any plans of staying Canada longer than I am required since I am now passionate with my venture in organic farming.

Just do your very best for the visa application.... one other point: presentation of documents/evidence matters.... prepare explanations/cross-references to evidence (if necessary)/use a highlighter to mark key points in evidence/number them (because the visa officer does not have time)
