Hi..friend
I need your kind advice:
My spouce(PR,on previous marriage based) has applied for me in Aug-09.File now approved(20thSept) from Missi.and sent to New delhi,India for further processing.We both were previously married to diff spouse.and then got divorce decree.
my ex-spouse was from USA and my visa from delhi,india on I130(spouse sponser) was rejected as we couldn't prove it as legel/Valid.so US rejected as this was for immigration.
Now one thing we missed while filling form for canada is I forgotten to tick yes in Imm0008_1e(background check) form that USa imign visa was rejected and details for that .
I dont have visa attend or rejection stamp on my passport.
I talked with my lawyer friend and he suggested me not to inform canada immigration about this at this stage,other wise they will suspect my current case also as immigration purpose and specially check for this.They told let the file to process as it is.if by chance they call me for interview then we can say that we missed or misunderstood as this information is applicable to canada only.

our current relation is geniun and as per law and cutome of marriage.we have proof of photo,email,phonebill,greeting card...etc already submitted with file

so friend I am confused what you suggest should i inform and take a risk of being called for interview or let it be?

Hey ,
First and for most never ever lie with immigration, because when you tell a lie , you will never know where to end, and over all they are trained to read body gesture and face gesture. When a person lie, his body gesture show it, and this is how they know, over all that they do lot of background check and they know everything.
About the lawyer, it is toooo expensive, mine was about 5000 US, . I guess it is a good idea to use a lawyer in your case, he will know excatly what format in writing will use inorder to inform them about the missing info in a way that won't show as mipresentation. In my case I wrote down the wrong info for the lawyer, and he is the one who made the cover letter and wrote down all the required info, after all that is why he is paid for.
I can't assume how will CIC look to the new info, because it is related to a previous sponsorship that was rejected based on mispresentation. So, the best way I guess is for you to find a cheaper lawyer in your region, and he will know excatly what to do, they have lot of info and experience. And you can re-post your question on the form by adding PMM or Leon to the title of the question asking there help, they are how to say , The Gods of Immigration here.

Well, that is a difficult situation but I think that you are better off to inform them of your "oversight" now. Do this with a lawyer so that they can best advise you how to do this. I would suggest that you NOT provide alot of details about the situation though -- they can investigate if they have questions. I hope that you provided lots of convincing evidence because they will scrutinize your case much more closely now knowing that you were rejected from another country with another spouse. But you are better off informing them because otherwise if you don't say anything and they find out by themselves you can be in a worse situation -- your file could be rejected for misrepresentation which would make it very difficult for you to ever apply again. I totally agree with ariell.
If I were you, I would contact my representative again and inform him that I don't intend to hide anything from CHC , by so doing, your conscience will be clear. Your representative can write a cover letter to the CHC informing them of your oversight/misunderstanding in filling the form out. If the CHC find out themselves(no one in this forum can be sure 100% that they won't find out), they might think you are deliberately hiding something from them. They have the right to refuse you saying you have misrepresented, believe me, they don't have to call you for interview before refusing your application if they find out themselves. They can also ban you for 2years and it may even take longer than that for them to be convinced you didn't do it on purpose. This is what I would do.

Today I re-sent imm0008_1e form with reject info . one copy to cic,missisuaga and one copy to new delhi by blue dart and fedex.
I consulted immigrant consultant in india before sending doc.

now let us see what happen ahead.
