Need help ! Is it possible to be refugee for me ?

Hello ,

I’m a oceangoing officer from Turkey. I want to explain my situation and ask for if i can be accepted as refugee and how much time it takes to get my residence. First of all thanks anyone who reads and tries to help me.

I am working on ships as 3rd captain and at 13 December 2018 when i get back home, police came to my home at early morning times and they told me there is an order to arrest me for my facebook sharings about marihuana. They search my home for any proof and they couldnt find anything and then they took my mobile phone and laptop and sent for investigation. They take me to police station and ask me questions. Btw there were 3 sharing; first shaing(taken from another page and just shared) is about using cannabis trees in industry like making rope, coat, medics, oil for cooking. also it was saying cannabis produces oxygen more than a tree. Second sharing was also taken from another fun page, there are some black guys making a blunt but it’s a fun video they cut weed like Nusret (Steakhouse owner) and they make saltbae(Nusret’s special move) with a fun music. Third sharing is my own sharing in a group i typed some funny things about weed. I told them all was not about showing cannabis good it was just for fun. Afterall they took me to pee test and they found Thc positive. And they blame me for being drug dealer and they also blame me for drug encouraging and also for drug using. In totally i ve none of transaction with any drug including weed.

Since 13 December 2018 yesterday i learnt they send a paper to my home that says they give me 1 year control. And in my situation i’m working in ships and i ve no choice to stay at home. I tried to talk judges but they even refused to talk with me.

The other problem since we have huge lacks of judge in Turkey and its known by everyone, i am really scared to go jail cuz of that they blame me for drug dealing.

I have months without a rest and sleep. I can’t handle it nor stop thinking about it and i’m really feeling that i ve to leave Turkey forever. And after researchs i found Canada is a good choice for me. But is my situation acceptable for it cuz i ve no proof since judge didnt start for me. They r not giving my folder or any information to me about all the things so i ve no documents to prove this for now.

Do you have a TRV to be able to go to Canada? If not, how were you planning to go to Canada to claim asylum? That is the most pressing issue.

Based on your story, I do not think your life is in danger. Not being able to leave your house does not warrant protection. But maybe I just don’t understand enough from Turkey.

Your second problem is you do not have proof. No proof pretty much means rejection.

I dont ve a trv but i can apply to a course or a language course for getting a trv so i dont think it ll be a problem.

Otherway my life is not in danger but there is a possibility to get in jail while i am not guilty and isnt it a danger ?

On proof yes u r right but maybe i wait until judgement starts so i ll be able to access the folder and i can make a copy.

I think you should research how easy/difficult it is to get a TRV first.

going to jail is not a danger to your life. You should hire a good lawyer to defend you. you should also research what types of danger is considered to be successful in an asylum claim.

Proof is REQUIRED so without it you do not stand a chance.

Agreed. A TRV can be no easy feat to obtain and the education progression for a SV must make sense. You may also find yourself criminally ineligible to enter Canada if there are charges (whether true or not) if there are charges related to drug dealing against you. The refugee program isn’t intended as a means of avoiding g criminal prosecution in your home country.

There are quite a few people who have received asylum due to persecution after the coup. You will need to bring proof of course but it is very difficult to get a TRV especially since so many Turkish citizens have been filing for asylum.

You may also find yourself criminally ineligible to enter Canada if there are charges (whether true or not) if there are charges related to drug dealing against you. The refugee program isn’t intended as a means of avoiding g criminal prosecution in your home country.
You must remember that while we can legally smoke Cannabis Canadians have strong laws regarding the provision and handling of the material.

ok I doubt your story has any chance for asylum what so ever.
While marihuana is now legal Canada, that is not the case all over the world (all you need is just to hit some states in USA).
Unfortunately that drug being illegal in your country is not considered a discrimination.
Save yourself troubles to try to get to Canada and claim for asylum only to be rejected. If ever you want to come here, try to find how to qualify for economic immigration.
Also as you now seems to have a kind of criminal record, you might need a rehabilitation first.

Feel like there wasn't a lot of the marijuana info before. this doesn't seem coup related so best to contact a lawyer to see if you have an asylum case before coming to Canada.

Absolutely. And while something is legal here, the penalties outside Canada that are imposed aren’t overlooked because it’s legal here.
