Need help - Getting separated before landing to Canada

Its my 1st time to send a query, hopefully someone can give me advise on how to proceed.

I already received my PR, i applied together with my common law partner and son, both of them received there PRs as well, my concern is my partner and i started to be cold to each other due to incompatibility of many things.

my question is do i have to report that he will not join me in canada? or is it ok not to report it po?

Yes you must inform CIC of the change in circumstances.

Thank you for your advise lammawicht, but do you think there will be an issue on my departure? i mean will they ask for additional requirements?

I am confused if you are already a PR or not. You say you received your PR but haven't landed? Many talk about having received PR as having received the PR visa even if they have not landed so in that case, you would not be a PR yet. However, many PR's also say they are landing when they are actually settling even if they have already landed. If you already landed with your PR visa, you are already a PR. If you are already a PR, you do not have to inform immigration about changes in your marital status.

If you are not yet a PR, you should inform them if you have split up for good in which case they may decide to cancel your partners visa and remove him from your application. If you are not certain that you have split up for good, it would be better not to inform them as him being excluded from your application can make it very tricky to sponsor him later.

apologies for not expounding my queries, i just received my passport with visa stamp and Permanent Residence form, we have not landed in canada, i will land, this december and he will follow next year before the visa validation expires.

Please advice how I can proceed. My wife will not be accompany me.

You must advise IRCC via webform that there has been a change in your family composition and that you are separating from your spouse. Hopefully you can provide some documentation about your separation or divorce filings. You will also need to show that your ex will allow your children to travel to Canada.

We only filed a petition in court mutually for divorce, it will take 6 months to finalise

Can I travel along with my children alone as my visa and copr will be expired by next month.

As IRCC Webform reply will take another 15 days. Please advice further

Yes - as long as you have written permission from your spouse for your children to travel with you.

Do IRCC change my COPR also as it is written married . After landing, do I need to declare the separation filling papers to immigration as well
If you have already filed for divorce you should not be landing as married. In the COPR it does indicate that you need to advise IRCC of the change in your family composition.
